<br /> En�iranmental Laws. Trustar authoriz�� Lend�r and its agents to enter upon the Praperty �a make such
<br /> inspections and tests, a� Trustor's expense, as Lender may deem appropriate to determine c�mp�iance �f the
<br /> Property with this sec�ion af th� D��d v� Trust. Any inspectians or �ests made by Lender shall be for Lender's
<br /> purposes only and shall no� be construed t� cr�at� any responsibi�ity or liabiiity on the par�of Lender to Trustar or
<br /> to any vther persvn. The representat�ons and warranfiies contained herein are based on Trustor's due diligence in
<br /> in��stigating the Proper�y for Hazardous 5ubstances. Trustor herehy {�� releases and wai�es any future claims
<br /> against Lender �or �ndemnity or c�ntr€�ution in �he e�ent Trustvr becames liahle �vr cleanup ar ather costs under
<br /> any such laws; and 4�� agrees to indemn��y, de�end, and hold harmless Lender agains�any and aii ��a�ms, Ivsses,
<br /> liab�[iti�s, damag�s, penal�ies, and expenses wh�ch Lender may directly ar indirectly sustain ar suffer resu�ting fram
<br /> a breach o�this sectivn ❑f the Deed of Trust or as a eonsequence of any use, genera�ion, manufacture, storage,
<br /> disposa�, r�lease ar threa�ened release occurring prior to Trustor's ownership or interest in the Prvperty, whether❑r
<br /> not the same was or should ha�e been known to Trust�r. The pro�isions of fihis section of �he []eed o� Trust,
<br /> in�luding the o�ligation to indemnify and defend, shafl sur�i�e the payment o�the Indebtedness and th�satis�action
<br /> and recon�eyance o�the lien of this ❑eed of Trust and shalf not be a�#ected by Lender's a�quisi�ivn vf any inte�est
<br /> in�he Property, whether by foreclosure or o�herwise.
<br /> Nuisance. Vllaste. Trustor shall not �ause, canduct or p�rmit any nuisance nor commit, permit, �r suffer any
<br /> stripping of or v►�aste on or to the Property ar any portivn of �he Prop�rty. VVithout �imiting the generali�y o� the
<br /> for�gving, Trustor will not r�mo�e, �r grant ta any ather par�y the right to rema�e, any ��mlaer, min�rals tincluding
<br /> ❑i! and gas�, coal, clay, s�aria, soil, gra�el or rock produc�s withau�Lender's prior written consent.
<br /> RemoWal v�[mproWements. Trustor shall not demolish or remo�e any lmpra�ements from the Real Property without
<br /> Lender's prior written consent. As a cvndition to the rema�al of any Impro�ements, Lender may require Trus�or to
<br /> make arrangements satisfactory �o Lender ta replace such Impra�emen�s wi�h Impr�Wements o� at isas� equal
<br /> �aiu�.
<br /> Lender's Right tv En�er. L�nder and L�nder's ag�nts and r�presentati�es may en�er upon the Real Praperty at all
<br /> reasonable times to a��end �o Lender's �nte�ests and to inspect the Real Property for purposes o� Trustar's
<br /> comp[iance with the terms and conditions o�this Deed o�Trust.
<br /> �ompliance with Go�ernmen�al Requirements. Trustor sha[( p�ompt�y comply with all laws, ordinances, and
<br /> regulations, now �r hereafter in �ffect, a� all ga�ernmental author�ties appiicable to the use ar accupancy o� �he
<br /> Property, inciuding without limitation, �he Americans Vllith Disabilities Act. Trust�r may contes� in good faith any
<br /> suGh �aw, ordinance, or re�ulation and wi�hhold �ompliance during any proceeding, including appropria�e appeais,
<br /> so Ivng as Trustar has noti�ied Lender in wri�ing prior�o doing s� and so I�ng as, in Lender's sole apinion, Lender's
<br /> interes�s in �he Property are not jeopardized. Lender may require Trustar tn post adequate seGurity or a surety
<br /> bond, reasona�ly satis�actory to Lender, to protect Lender`s in�erest.
<br /> Du#y to Prote�t. Trustor agrees ne�ther to ahandon or lea�e unattended the Praperty. Trustor shai{ do all other
<br /> acts, in additivn to those acts set forth aha�e in�his section, which frvm the character and use of the Prop�rty are
<br /> reasonab�y necessary�o pro�ec�and preser�e the Property.
<br /> ❑UE aN SALE- CDNSENT BY LENDER. L�nder may, a� Lender's option, deciare immediate�y due and payable all sums
<br /> secured by this Deed of Trust upon the sale or transfer, withou� Lender's prior written �ansent, of al� or any par��f the
<br /> Rea� Property, or any interest in the Rea� Property. A "sale or transfer" means�he �on�eyance of Rea� Praperty or any
<br /> right, �itle �r interest in the Rea[ Property; whether legal, �eneficial or equi�able; whether �oluntary or in�olun�ary;
<br /> whether by outrigh� sale, de�d, instal[m�nt sa�� contract, land cantract, contra�t �or d�ed, leasehold int�rest with a
<br /> term gr�ater�han three �3� years, lease-option contra�t, a� by sa�e, assignment, or �ransfer of any heneficia[ interest in
<br /> or to any fand trust hvlding title t❑ the Real Pr�perty, or by any other method of c�n�eyance of an in�er�st in the Real
<br /> Praperty. Howe��r, �h�s vption shall no� he exercised by Lender if such exercise is prohib�ted by �Fed�ral �aw or by
<br /> Nehraska law.
<br /> TAXES AND LIENS. The follvwing pra�isions r�lat�ng ta the taxes and liens on 'the Praperty ar� part of this ❑eed af
<br /> Trust:
<br /> Paym�nt. Trustor shall pay when due �and in all e�ents pri�r t� definquency} a���axes, special taxes, ass�ssments,
<br /> charges �inc�uding water and sewer�, �ines and impositions le�i�d against or on accnunt o#the Proper��, and sha�l
<br /> pay when due al� c�a�ms �or wark dvne on or for ser�iees rendered or materiai furnished to the Property. Trustor
<br /> shall maintain the Praperty free of all liens ha�ing priority o�er ar equal tp the interest of Lender under this ❑eed o�
<br /> Trust, exGep� fvr the lien of taxes and assessments not due and except as o�herwise pro�ided in this Deed of
<br /> Trust.
<br /> Right to Can�est. Trus�or may withhold payment of any tax, assessment, or claim in cvnnec�ion wi�h a good �aith
<br /> dispufie o�er�he obliga�ivn to pay, s� long as Lender's interest in�he Prap�rty is not jeopardized. lf a lien arises or
<br /> �s filed as a result �fi nonpayment, Trus�or shall within fifteen �15� days a�ter the lien arises or, if a lien is filed,
<br /> within fifteen �153 days after Trus�or has noti�e of the filing, secure th� discharge o� the lien, or if requested by
<br /> Lender, deposit with Lender cash or a sufficient carpora�e sure�y b�nd or a�her security satis�actory to Lender in an
<br /> amvunt sufficient ta d€s�harge the lien plus any costs and a��orneys' fees, or vther charges that could �ccrue as a
<br /> result vf a foreclosure❑r sale under the l�en. In any contest, Trustor shall defend itself and Lend�r and shall satisfy
<br /> any ad�erse judgmen�bef�re enfarcement against the Prop�rty. Trustor shall name Lender as an additional ob�igee
<br /> under any surety k�ond furnished in�he ��ntest proceedings.
<br /> E�idence ❑# Paynnent. Trustflr shall upon demand �urnish ta Lend�r satisfactory e��dence �� paymen� of the taxes
<br /> or assessments and shall author�ze the appropriate go�ernmental ❑fficial to deli�er to L�nder at any time a writ�en
<br /> statemen�of�h��ax�s and assessments against the Property.
<br /> N�tice o� Cvns�ruc�ion. Trustor shaf[ noti�y Lender at �east �ifteen �15} days befare any work is commenced, any
<br /> ser�ices are fiurnished, or any materiafs are suppiied to th� Praperty, i� any mechanic's �ien, ma�eriafinen's I�en, ar
<br /> other lien cou�d b� asserfied on ac�oun� �f the wark, ser�ices, or mat�r�a�s. Trustar will upon request af Lender
<br /> �urnish to Lender ad�an�e assurances satisfact�ry to Lender that Trustor can and will pay �he cost o� such
<br /> impro�ements.
<br /> PRDPERTY DAMAGE INSURANCE. The following pro�isions relating to insuring the Property are a part of�his ❑e�d a�
<br /> Trust.
<br /> Main�enan�e ❑f InsuranGe. Trustar shall pro�ure and maintain p�licies vf fire insurance with standar�! ex�ended
<br /> ca��rage endorsements vn a r�p�acement basis for the full insurable �alue co�ering all Impro��ment� on the Real
<br /> Property in an amount su�f�c�ent ta a�oid application af any coinsurance clause, and with a standard mor�gagee
<br /> ciause in�a�or of Lender. Trustor sha�l also procure and maintain comprehensi�e general liab���ty insuran�e �n such �,
