Locust Street, Grand Island, NE <br />68801, for and in consideration of One Hundred Thousand and no /100 ($100,000.00) Dollars, in hand <br />paid, hereby grants to Mountain Tower & Land, LLC, a Colorado limited liability company, or its <br />Designee, ( "Grantee "), whose address is 1224 W. Platte Avenue, Fort Morgan, CO 80701, a Permanent <br />Tower Site Easement and Access Easement (together the "Easement "), for the construction and operation <br />of a telecommunications tower and related facilities (the "Improvements "), over, under and across the <br />following described real estate, to wit: <br />A parcel of land located in Lot 2, Fonner Second Subdivision, Grand Island, Hall County, Nebraska, <br />being described as follows: Referring to the Northeast Corner of Lot 10, Santa Anita Estates Subdivision, <br />in the City of Grand Island; thence N01 °06'24 "W (assumed bearing) on the East Line of Lot 2, Fonner <br />Second Subdivision, a distance of 169.41 Feet to the point of beginning; thence continuing N01 °06'24 "W <br />on said East Line, a distance of 100.0 Feet; thence S89 °23'09 "W, parallel with and 30.00 Feet distant <br />from the North Line of said Lot 2, a distance of 100.00 Feet; thence S01 °06'24 "E, parallel with said East <br />Line, a distance of 100.00 Feet; thence N89 °23'09 "E, parallel with said North Line, a distance of 100.00 <br />Feet to the point of beginning, containing 0.22 acres, more or less. <br />Location of Access Easement: <br />A parcel of land located in Lot 2, Fonner Second Subdivision, Grand Island, Hall County, Nebraska, <br />being described as follows: Referring to the Northeast Corner of Lot 10, Santa Anita Estates Subdivision, <br />in the City of Grand Island; thence N01 °06 (assumed bearing) on the East Line of Lot 2, Fonner <br />Second Subdivision, a distance of 269.41 Feet; thence S89 °23'09 "W, parallel with and 30.00 Feet distant <br />from the North Line of said Lot 2, a distance of 100.00 Feet to the point of beginning; thence continuing <br />S89 °23'09 "W, parallel with and 30.00 Feet distant from said North Line, a distance of 71.24 Feet; thence <br />S00 °34'35 "E, parallel with and 20.00 Feet distant from the West Line of an existing City of Grand Island <br />Utility Easement described and recorded in Instrument Number 200111256, a distance of 269.57 Feet to <br />the North Line of said Santa Anita Estates Subdivision; thence N89° 19'46 "E, on said North Line, a <br />distance of 20.00 Feet to the Southwest Corner of said Existing Utility Easement; thence North <br />N00 °34'35 "W on the West Line of said existing Utility Easement, a distance of 249.55 Feet; thence <br />N89 °23'09 "E, parallel with and 50.00 Feet distant from the North Line of said Lot 2, a distance of 51.42 <br />Feet; thence N01 °06'24 "W, a distance of 20.00 Feet to the point of beginning, containing 0.14 acres, more <br />or less. <br />Collectively the Easement, as set forth in the attached survey, marked as Exhibit "A," which is incor- <br />porated herein and made a part hereof. <br />Grantee shall acquire and maintain all necessary local, state and federal governmental approvals <br />to construct and use the Improvements. If after timely construction of the Improvements, Grantee or its <br />successors or assigns fail to use the telecommunications tower for telecommunications, weather, or radio <br />purposes for a period of twelve (12) consecutive months, Grantee or its successors or assigns shall, within <br />ninety (90) days, remove all improvements and personal property located thereon and restore the above - <br />described real estate to substantially the same condition as received, reasonable wear and tear excepted. <br />
