<br /> "t This Sign Easement Agreement (the "Agreement") is hereby made as of the f S} day
<br /> k of May, 2016 by and between MID-COUNTRY TRADING, L.L.C., a Nebraska limited liability
<br /> company, , with a business address of 2502 A North Webb Road, P.O. Box 139, Grand Island,
<br /> Nebraska 68803 ("Grantor") and KM GRAND ISLAND JOINT VENTURE, LLC, a Missouri
<br /> limited liability company("Grantee').
<br /> RECITALS:
<br /> A. Grantor is the owner of that certain parcel of real property situate in the City of
<br /> Grand Island, County of Hall, State of Nebraska, which is more particularly described in Exhibit
<br /> A attached hereto and made a part hereof(the "Land"), which property is located adjacent to that
<br /> certain parcel of real property owned by Grantee situate in the City of Grand Island, County of
<br /> Hall, State of Nebraska, which is more particularly described in Exhibit B attached hereto and
<br /> made a part hereof(the"Grantee's Property").
<br /> B. Grantee has requested and Grantor has agreed to grant to Grantee an easement for
<br /> the construction, use, modification, and maintenance of a pylon sign to serve Grantee's Property
<br /> and to advertise for such other properties as Grantee shall elect, all as hereinafter set forth.
<br /> NOW, THEREFORE, in consideration of Ten Dollars ($10.00), the covenants contained
<br /> herein and other good and valuable consideration, the receipt of which is hereby acknowledged,
<br /> the parties hereto hereby agree as follows:
<br /> 1. Grant of Sign Easement. Grantor hereby grants, conveys, extends and confers
<br /> unto Grantee, its successors and assigns, a perpetual, exclusive, right, privilege and easement
<br /> appurtenant to and running with the Grantee's Property to construct, modify, maintain, repair,
<br /> replace and inspect a sign(the initial sign and any substitute sign is collectively referred to herein
<br /> as the "Sign") on the Land as shown on the site plan attached hereto as Exhibit C (the "Sign
<br /> Easement Area").
<br /> 2. Grant of Access Easement. Grantor hereby grants, conveys, extends and confers
<br /> unto Grantee, its successors and assigns, a non-exclusive perpetual right,privilege and easement,
