<br />DEED OF TRUST
<br />This DEED OF TRUST is made as of the 13 day of April, 2016, by and among Douglas
<br />John Carter, a single person ( "Trustor "), whose mailing address is 10590 S. 190 Road, Wood
<br />River, NE 68883; Larry W. Beucke, a member of the Nebraska State Bar Association ( "Trustee "),
<br />whose mailing address is P.O. Box 1600, Kearney, Nebraska 68848 -1600; and Peggy Sue Carter
<br />now known as Peggy Sue Enck ("Beneficiary"), whose mailing address is 1136 Pleasant View
<br />Drive, Grand Island, NE 68801.
<br />FOR VALUABLE CONSIDERATION, Trustor irrevocably transfers, conveys and assigns
<br />to Trustee, IN TRUST, WITH POWER OF SALE, for the benefit and security of Beneficiary, under
<br />and subject to the terms and conditions of this Deed of Trust, the real property, described as follows
<br />(the "Trust Estate "):
<br />A tract of land comprising a part of the East Half of the Southeast Quarter
<br />(E' /ASE %) of Section Six (6), Township Nine (9) North, Range Twelve (12)
<br />West of the 6th P.M. Hall County, Nebraska and more particularly
<br />described as follows: Beginning at a point on the east line of said East Half
<br />of the Southeast Quarter said point being three hundred seventy (370) feet
<br />south of the Northeast corner of said East Half of the Southeast Quarter;
<br />thence deflecting right 89° 07' and running Westerly a distance of three
<br />hundred two and twelve hundredths (302.12) feet; thence deflecting left 79°
<br />51' and running Southwesterly a distance of two hundred ninety -eight and
<br />seventy three hundredths (298.73) feet; thence deflecting left 32° 21' and
<br />running Southeasterly a distance of one hundred twenty -four and four
<br />hundredths (124.04) feet; thence deflecting left 65° 36' and running
<br />easterly a distance of three hundred one and thirty -four hundredths
<br />(301.34) feet to a point on the east line of the East Half of the Southeast
<br />Quarter, thence running north along the east line of said E'/ZSEI /4, a
<br />distance of four hundred twenty and forty -five hundredths (420.45) feet to
<br />the point of beginning.
<br />TOGETHER WITH all rents, easements, appurtenances, hereditaments, interest in adjoining
<br />roads, streets and alleys, improvements and buildings of any kind situated thereon, and all personal
<br />property that may be, or hereafter become, an integral part of such buildings and improvements, all
<br />crops raised thereon and all water rights.
<br />The Property and the entire estate and interest conveyed to the Trustee are referred to
<br />collectively as the "Trust Estate ".
<br />This is a Purchase Money Deed of Trust
<br />I. FOR THE PURPOSE OF SECURING:
<br />A. Payment of indebtedness in the total principal amount of $54,000.00, with interest
<br />thereon, as evidenced by that certain promissory note of even date (the "Note ") with a maturity date
<br />of April 1, 2021, executed by Trustor, which has been delivered and is payable to the order of
<br />Beneficiary, and which by this reference is hereby made a part hereof, and any and all modifications,
<br />extensions and renewals thereof, and
