<br /> Possessivn and Use. Until the occurrence �f an E��nt af De�au�t, Trustor may �1} remain in pvssession and
<br />� �on�rol of the Praperty; �2� use, aperate or manage the Prop�r�y; and �3� collec�the Rents trom�he Praperty.
<br />: ❑uty �o Maintain. Trus�ar shall ma;n�ain �he Praperty in tenantable �ond�tion and prompt�y perform all repa�rs,
<br /> r�placemen�s, and maintenan�e necessa�y�ko preser�e its value.
<br /> Comp[iance Wi�h En�ironmentai Laws. Trus�or represents and warrants to Lender that: ��} ❑uring the peri�d of
<br /> Trustor's ownership�fi the Prop�rty, the�e has been n❑ use, generation, manu�acture, s�orage, treatment, disposal,
<br /> reieas� ar threatened re�ease ❑f any Hazardous Substanc� by any persvn an, under, about or fram the Praperty;
<br /> ��} Trustor has no kn�w�edge o�, or r�ason t❑ b�lie�e that�here has been, except as pre�iously discfvsed to and
<br />� acknowledged by Lend�r tn wri�ing, {a} any breach ❑r violatian of any EnWironmen�al Laws, �b� any use,
<br /> generation, manufac�ure, storage, �reatment, d�sposa[, releas� ❑r �hrea�ened re�ease a� any Hazar�dous 5ubs�an�e
<br />; an, under, about or from th� Property by any prior own�rs ar occupants o� �he Property, ❑r �c} any actual or
<br /> threa�ened li�igatifln ❑r claims ❑f any kind by any person re�ating t� such ma��ers; and {3� Except as pre�iausly
<br />� dis�losed to and acknawledged by Lender in writing, {a� neither Trustor nor any tenan�, contract�r, agen�❑r oth�r
<br /> authorized user of�he Property shafl use, genera�e, manufac�ure, stvre, trea�, d�spose ❑�or release any Ha�ard�us
<br /> Substance on, under, abou�or from the Property; and {b} any such acti�ity shai� be conducted in compliance with
<br />; all appl�cab[e federal, s�a�e, and loca� laws, regulatians and ordinances, inc�udEng withaut �im�tation all
<br /> �� En���onmental Laws. Trustor au�hari�es Lender and its agents fio en�er u�an the Property to make such
<br />� ; inspe�tions and ��sts, a� Trustor's expense, as Lender may deem appropriafie to de�ermine compliance of the
<br /> Property with �his section flf the ❑�ed of Trust. Any €nsp��tions �r tests made by Lender shall be for Lender's
<br /> purp�ses only and shall no� be construed to �reate any responsib3�Ety or [iability on the part of Lender to Trustor ❑r
<br />' t❑ any o�her person. The repr�sentations and warranties �ontained herein are laased ❑n Trustor's due diligence in
<br /> in�esti�a�ing the Property for Hazardous 5ubstances. Trustor hereby {�y releases and waiWes any �uture cfaims
<br /> agains� Lender for indemnifiy ❑r contrilautifln in the eUen� Trus�ar becomes liable for cleanup �r a�her cos�s under
<br /> . any such lainrs; and {2} agrees t❑ indemnify, defend, and hold harmless Lender against any and all �laims, losses,
<br /> liabilities, damages, penalties, and expenses which Lender may direc��y or indirectly sustain or suffer r�sul�ing from
<br /> a brea�h of�his sec�ivn of�h� ❑e�d of Trust or as a consequ�nce of any use, generati�n, manu�facfure, st�rage,
<br /> disposa[, rel�ase or threatened release occurring prior�o Trus�ar's ownership or int�res�in�he Property, whether vr

<br />� Nuisance, Was#e. Trusta�- shall not cause, c�nduct ❑r permit any nuisance nor comrimit, permit, ar su�r�er any
<br />, s�ripping of ❑r waste on or to �he Prvperty or any portEon of the Property. Without limi�ing the generality ❑f the
<br /> �oregoing, Trustor will not remove, ❑r gran�ta any ❑ther party the righfi fio remo�e, any�imber, m�nera�s {includ�ng
<br />� oi� and gas}, coal, clay, scoria, soil, gra�el or rock products without Lender's prior written cansen�.
<br /> Remo�al o�lmprvvements. Trustar shali not demalish or remv�e any #mproWemen�s from th� Real Property vv�thaut
<br />, L�nder's priar written �ansent. As a c�ndition �o�he remo�a! of any Impra�ements, L�nder may require Trustor to
<br /> make arrangements sa�isfact�ry to Lsnd�r to replacs such �mproWements wi�h Impro�ements ❑f at �east equal
<br /> �alue.
<br />. Lender's Right#o En#er. Lender and Lender's agen�s and represen�at��es may enter upan -khe Real Praperty a��all
<br /> reasona��e times �❑ a��end ta Lender`s in�erests and to inspect the Real Property �or purposes of Trustar's
<br /> compliance with the terms and conditions❑t this Deed o�Trust.
<br /> Compliance wi�h Governmental Requirements. Trustar shall promptly cvmply wi�h all laws, ordinances, and
<br /> regulations, now ❑r hereafter in eff�c�, ot aEI go�ernmenta� authari�ies applicable to �he use �r o�cupancy ❑f �he
<br /> � Praper�y, inciuding without Iimitation, the Amer�cans 1Nith Disabilities Act. Trus�or may contes� in gaad faith any
<br /> such law, flrdinanc�, or regulation and withho�d �ampliance during any procesding, including appropriate appea�s,
