<br /> �n�es�igating the Praperty for Hazardous Substances. Trustor here�y �1� releases an�f wai��s any future claims
<br /> against Lender #ar indemnity ar contri�ution in th� e�ent T�ustor becomes liahi� for �I�anup or other casts under
<br /> any su�h laws; and (2� agrees to indemnify, defend, and hold harm[ess Lender aga�ns� any and all claims, Ivsses,
<br /> liahili�ies, damages, penalties, and expenses which Lender may dire�tly or indirect�y sustain or suffer resuftin�#rom
<br /> a breach of th�s sec�ivn ofi th� Deed of Trust or as a cansequence of any use, generatian, manufacture, starag�,
<br /> dispasal, re�ease❑r threatened release oc�urring prior ta Trus�or's ownership vr in�erest in the Property, whether or
<br /> � no� the same was or shou�d ha�e heen known t❑ Trusta�. The pro�isions o� this se��ivn ofi the ❑eed af Trus�,
<br /> including the obfigatian to indemnify and d��end, sha[�sur�i�e the paym�nt v�the Indebtedness and the satisfaction
<br /> and recon�eyance of the �ien of�his Deed of Trust and shaff nv�be affec�ed by Lende�'s a�quisitian Qf any interest
<br /> in the Property, whe�her by foreclosure❑r o�herwise,
<br /> Nuisance, Vl�aste. Trustor sha�l not �ause, canduct or permit any nuisance nor corr�mi�, perm�t, or suffer any
<br /> s�ripping �� �r ►rvaste on or t� the Property ar any po�tifln o� the Property. Withou� limiting the generali�y of the
<br /> �oregving, Trustor wi[I not remo�e, ar grant�o any other party�he right to r�mv�e, any timber, mine�ais �including
<br /> oil and gasy, cvaf, clay, scoria, s�il, gra�el or rock products without Lend�r's pri�r writt�n consent.
<br /> R�mo�al o�ImproWements. Trustor shall nv�demolish ar remo�e any Impro�ements fr�r�the R�al Prop�r�y without
<br /> Lender's prio�written consent. As a conditian to the remo�al of any Impro�ements, Le�der may require Trustor to
<br /> make arrangements satis�aGtory to Lende�- to replace such lmpro�ements wi�h Imprc�ements o� at least equal
<br /> �alue.
<br /> Lender`s Right#o En�er. Lender and Lender's agents and representati�es may enter uF�on the Real Property at all
<br /> r�asonable �imes ta attend �o Lender's in�eres�s and �o inspec� �h� Real Property for purposes of Trust�r's
<br /> comp�iance with the t�rms and conditions of this aeed of Trusfi.
<br /> Compliance w'rth Gavernmental Requ�remen#s. Trustor shail promptly comp�y with all laws, ordinanc�s, and
<br /> regula�ions, now ar hereafter in effect, of all go�ernmentaf autharities appli�ab�� to th� use or occupancy vf th�
<br /> Property, including withou� limitation, �he Ameri�ans With Disabilities Act. Trustor ma� contest in good faith any
<br /> such law, ordinance, or regulation and wi�hhold complianGe during any pro�eeding, inc�ud�ng appropria�e appea[s,
<br /> so �ong as Trust�r has nvt��ied Lender in wri�ing prior to doing so and so lan� as, in Lender's s�fe opinivn, Lender's
<br /> interests in the Pr�perty are not jeopard�zed. Lender rnay require Trustor t❑ post adEqua�� s�curity ❑r a 5urety
<br /> band, reasonably satisfactory tv Lender, ta prvte�t Lender's interest.
<br /> Du#y to Prv#ect. Trustar agrees neither to abandon or lea�e unat�ended the Property. Trust�r shail do all oth�r
<br /> acts, in addition to�hos� ac�s set forth aho�e in this sect�on, which from the �harac�er and use o��he Proper�y are
<br /> reasonably necessary ta p�atect and pr�ser�e the Prop�rty.
<br /> DUE QN SALE- C�NSENT BY LENDER. Lender may, at L�nd�r's ❑p�tian, declar� immediatel��due and payabl� al� sums
<br /> secured by this D��d of Trust upon the sale ar transfer, withou'� Lender's prior written cons�nt, vf all or any part❑��he
<br /> Reai Prflperty, or any interest in �he Real Prvperty. A "sale ❑r�ransfer" means the can�eyar��e of Real Praper�y vr any
<br /> right, �it�� or interest in �the Real Property; whether legal, beneficial or equi�able; whe�he� �oluntary or in�oluntary;
<br /> whether by outright sa�e, deed, insta��ment sai� contrac�, land �ontract, cflntract for deed, ieaseho[d interest with a
<br /> term greater than �three �3� years, lease-opt�on contract, or by sale, assignment, vr transfer�f any bene�ic�a� interest in
<br /> or to any land trust holding titfe to the Real Property, or by any ather method ofi con�eyan�� of an inter�st in the Real
<br /> Proper�y. if any Trustor is a cvrporation, partnership or limited liabi[ity c�mpany, �rans�er �ls❑ includes any change in
<br /> awnership of more than twen�y-fi�e perGent {2�°/Q� af the�vting stock, partnership inter�sts or limited fia�ility c�mpany
<br /> interests, as the case may be, af such Trustor. Howe�er, this vp�ion shall n�t be exer�ised by Lender if such exercise
<br /> is prahibited by�ederal law or by Ne�raska law.
<br /> TAXES AiVO LIENS, The �o[�owing pr��is�ans re�ating to the taxes and liens on the Proper�y are part af this Deed of
<br /> Trust:
<br /> PaymQnt. Trustor shall pay when due tand in all e�ents prior to delinquency� all taxes, �pecial taxes, assessm�nts,
<br /> charges ��ncluding �►va�er and sewer�, �ines and imposi�ions le�ied agains�or on account af th� Property, and sha(f
<br /> pay wh�n due al� claims for work done on or for ser�ices rendered vr material furnishe�� tv th� Property. Trustor
<br /> shall maintain�he Prop�rty free of al� liens ha�ing pr�ority ❑�er or equa�to the interest o� Lender und�r th�s Deed of
<br /> Trus�, excep� fior the (ien of taxes and assessments not due and except as otherwise prv�ided in this ❑e�d of
<br /> Trust.
<br /> Right#o Contest. Trustar may wi�hhold payment of any tax, assessmen�, or claim in c��nnection wi�h a good fa�th
<br /> d�spute o�e�the ohligation to pay, s❑ [ang as Lender's interest in the Proper�y is na�jeo�ardi��d. If a [ien arises or
<br /> is fifed as a resuit o� nonpayment, Trustor shal! within fi#teen �15} days after the fien arises or, �it a lien is �iled,
<br /> wi�hin fifteen �15y days after Trustor has nvtice o� the filing, secu�� the discha�ge of t�e lien, or if request�d by
<br /> Lender, deposit with Lender cash or a sufficient carporate surety b�nd�r ather security satisfac�ory tv L�nder in an
<br /> amoun�sufficient�o dis�harge the lien plus any costs and attorneys' fees, or v�her char�es thafi could accrue as a
<br /> resu�t of a��reclasure or sale under the lien. In any contes�, Trustor shall defend itseff a�d Lender and shall satis�y
<br /> any ad�ers�judgment hefore en��rcement against the Praperty. Trustor shall name Lender as an additivnal ❑bligee
<br /> under any surefiy bond furnished �n the contest proceed�ngs.
<br /> E�idence of Payment. Trustor shall upan demand furnish t� L�nder satis�actary e��dence of payment of�h� tax�s
<br /> or assessments and shall authorize the appropriate gv�ernm�ntal vfificiaL �� de[��er�o L�nder at any time a written
<br /> statemen�of the taxes and assessments against the Pr�perty.
<br /> No�ice vf�onstruc�ion. Trustor shall natify Lender at least fifteen {15} days be�ore an�� work is commenc�d, any
<br /> se��ices are furnished, ar any ma�erials are supplied tv the Proper�y, if any mechani�'s lien, materialmen's lisn, or
<br /> other i�en could be asserted on account of the work, ser�ices, ar materials. Trus�or �rvifl upon �equest of Lender
<br /> furnish ta Lender ad�ance assurances satisfactory to Lender that Trustor can and �vill pay the cost vf su�h
<br /> impro�ements.
<br /> PR�PERTY DAMAGE INSURANCE. The fo!lowing pra�isions re�a��ng to insuring ths Property are a part af this Deed of
<br /> Trus�.
<br /> Main�enance vf Insu�ance, Trustor shall procure and maintain poli�ies of fire insuran�e with s�andard extended
<br /> ca�erage endorsements on a repla�ement t�asis for the �ull insurable �alue co�ering ail lmpro�ements on �he Real
<br /> Proper�y in an amount sufficien� to a�oid appli�ation of any �vinsurance clause, and v��ith a standard mortgagee
<br /> c�ause in fa�or vf Lender. Trus'�or shall also procure and main�ain comprehensi�e gen�r�i liabi�ity insuran�e in such
<br /> ca�erage amounts as Lender may reques� wi�h Trus�ee and Lender being named as add�tional insureds in such
<br /> liability insurance poli�ies. Additivnally, Trus�or shall maintain such other insurance, inc(ud�ng }�ut not limited ta
<br /> hazard, t�us�ness interruptian, and boiler insurance, as Lender may reasanably require. ?oli�ies shall be written in
