Trusto� shall promptly comply with a�� iaws, ordinances, and <br /> �-egulations, now or hereafter in effect, of all governmenta! authorities appfEcab[e to the use or occupancy of the <br /> Property, including without �im�tat�on, the Americans With Disabilities Act. Trustor may contest in good faith any <br /> such law, ordEnance, or regulation and withhold compliance during any proceeding, inc�uding appropriate appeals, <br /> so Iong as Trustor has notified Lender�n writing prior to doing so and so fong as, �n Lender's sole opinion, Lender's <br /> Enterests in the Property are not jeopardized. Lender may require Trustor to post adequate secu�ity or a surety <br /> bond, reasonably sat�sfactory to Lender, to protect Lender's interest. <br /> Duty to Protect. Trustor agrees neither to abandon or leave unattended the Property. Trustor sha�E do all other <br /> acts, in addition to those acts set forth above in this section, which from the character and use of the Property are <br /> reasonably necessary to protect and preserve the Property. <br /> DUE ON SALE - CONSENT BY LENDER. Lender may, at Lender's option, declare immediate�y due and payable a!I sums <br /> secured by this Deed of Trust upon the safe or transfer, without Lender's prior written consent, of a!! or any part of the <br /> Real Property, or any interest in the Reaf Property. A "sale or transfer" means the conveyance of Rea! Property or any <br /> right, title or �nterest �n the Real Property; whether legal, beneficia� or equitable; whether voluntary or involuntary; <br /> whether by outright sale, deed, installment sale contract, land contract, contract for deed, leaseho�d interest with a <br /> term greater than three �3} years, lease-option contract, or by sale, assignment, or transfer of any beneficia! interest in <br /> or to any land trust hold�ng title to the Real Property, or by any other method of conveyance of an interest in the ReaE <br /> Property. Trustor <br /> shafl maintain the Property free of aEl liens having priority over or equa� to the interest of Lender under this Deed of <br /> Trust, except for the �Een of taxes and assessments not due and except as otherwise provided in this Deed o� <br /> Trust. � <br /> Right to Cnntest. Trustor may withhold payment o�any tax, assessment, or claim in connectEon with a good faith <br /> dispute over the obligation to pay, so fong as Lender's interest in the Property is not jeopardized. If a lien arises or <br /> �s filed as a result of nonpayment, Trustor shal! within fifteen ��5} days after the lien arises or, �f a �ien is filed, <br /> with�n ��fteen ��5� days a�ter Trustor has notice of the �il�ng, secure the discharge of the lien, or if requested by <br /> Lender, deposit with Lender�ash or a sufficient corporate surety bond or other security satisfactory to Lender in an <br /> amount suf�icient to discharge the lien plus any costs and attorneys' �ees, or other charges that coufd accrue as a <br /> result of a f�reclosure or sale under the fien. In any contest, Trustor shall defend itself and Lender and sha!!satEsfy <br /> any adverse judgment before enforcement aga�nst the Property. Trusto�shalf name Lender as an additionai obl�gee <br /> under any surety bond furnished in the contest pr�ceedings. <br /> E�idence nf Payment. Trustor shafl up�n demand furnfsh to Lender satisfact�ry evidence of payment of the taxes <br /> or assessments and shafl author�ze the appropriate governmental �ff�c�al to delEver to Lender at any time a written <br /> statement of the taxes and assessments against the Property. <br /> Nntice of Construction. Trustor shall noti�y Lender at least fifteen ��5� days before any work is commenced, any <br /> services are furnished, or any materials are supplied to the Property, if any mechanic's lien, materiaimen's fien, or <br /> other lien could be asserted on account of the work, serv�ces, or materiafs. Trustor w��l upon request of Lender <br /> furnish to Lender advance assurances satisfactory to Lender that Trustor can and wil! pay the cost of such <br /> Emprovements. <br /> PROPERTY DAMAGE 1NSURANCE. The following provisi�ns relating to insurfng the Property are a part of thEs Deed of <br /> Trust. <br /> Maintenance nf lnsurance. Trustor shall procure and maintain p�licies of fire insurance with standard extended <br /> coverage endorsements on a fair value basis for the full insurable value covering all lmprovements on the Rea! <br /> Property in an am�unt sufficient to avoid application af any c�insurance clause, and with a standard mortgagee <br /> cfause in favor of Lender. Trustor shal! also pr�cure and mainta+n comprehensive generaf Eiability insurance in such <br /> coverage amounts as Lender may request w�th Trustee and Lender being named as add�tEonal insureds in such <br /> liabilEty insurance policies. Additionally,�Trustor shall maintain such other insurance, including but not limited to <br /> hazard, business interruption, and b�fEer insurance, as Lender may reasonably require. Po[icies shaff be written in <br /> form, amounts, coverages and basis reasonably acceptable to Lender and fssued by a company or compan+es <br /> reasonably acceptable to Lender. Trustor, upon request of Lender, wfff deiiver to Lender fr�m time to time the <br /> p�lfcies or cert�ficates of insurance in form satisfactory to Lender, including stipulations that coverages wiii not be <br /> cancelled or diminished without at least ten ���� days prior written n�tice t� Lende�.
