EASEMENT AND RIGHT -OF -WAY

<br />TEMPORARY CONSTRUCTION EASEMENT
<br />KNOW ALL MEN BY THESE PRESENTS, that CHARLES A. MEAD and JUDITH
<br />A. MEAD, Husband and Wife, GRANTORS; in consideration of Five Hundred Fifty Two
<br />Dollars and Fifty Eight Cents ($552.58), receipt of which is hereby acknowledged, does
<br />hereby give, grant, and convey unto the CITY OF WOOD RIVER, NEBRASKA, a
<br />municipal corporation, GRANTEE, a perpetual easement and right -of -way over, across,
<br />under, through, and upon the following- described real estate, to -wit:

<br />Said easement includes but is not limited to the right to install, construct,
<br />maintain, replace, and operate public utility facilities by the GRANTEE in, on, over, or
<br />under the described easement area in connection with its public utility systems. It is
<br />further provided that said easement shall be deemed to provide GRANTEE with the
<br />right of unrestricted access to its public utility facilities by ingress and egress over,
<br />across, through, and under the lands described herein, together with all rights of ingress
<br />and egress necessary for the full and complete use, occupation, and enjoyment of the
<br />easement hereby granted, including the right to excavate and refill ditches and
<br />trenches for the location of said facilities and appurtenant structures related thereto, and
<br />hereby prohibiting the planting of trees, bushes, and shrubs, or placing other
<br />obstructions, in, upon, above, along, over, across, underneath, and through the
<br />easement area.
<br />To have and to hold the same unto the said GRANTEE and its successors and
<br />assigns as appurtenant to the land and every part thereof; and GRANTORS hereby
<br />dedicate their respective interests in said real estate to the use of the GRANTEE. This
<br />easement is perpetual and shall run with the land.
<br />In addition to the perpetual easement granted hereinabove, GRANTORS, for the
<br />purpose of permitting initial construction, stockpiling of materials, parking of equipment,
