the City of Grand Island, Hall County, Nebraska; the centerline of the Twenty (20.0) foot wide
<br />easement and right -of -way being more particularly described as follows:
<br />Beginning at the southwest corner of said Northwest Quarter (NW' /4); thence running
<br />easterly along the south line of said Northwest Quarter (NW' /4), to a point Eight
<br />Hundred Seventy Nine and Three Tenths (879.3) feet east of the west line of said
<br />Northwest Quarter (NW' /4); thence running northerly parallel with and Eight Hundred
<br />Seventy Nine and Three Tenths (879.3) feet east of the west line of said Northwest
<br />Quarter (NW' /4), a distance of approximately Four Hundred Ninety Seven and
<br />Twenty Two Hundredths (497.22) feet, to a point on the southerly line of said
<br />Thavenet Ice Pond Tract and the ACTUAL point of beginning; thence continuing
<br />northerly parallel with and Eight Hundred Seventy Nine and Three Tenths (879.3)
<br />feet east of the west line of said Northwest Quarter (NW' /4), a distance of
<br />approximately Three Hundred Eighty Nine and Six Tenths (389.6) feet, to a point on
<br />the southerly line of Lot Three (3), MIL -NIC Addition and to the point of
<br />termination, said tract containing 0.179 acres more or less;
<br />together with the following rights, namely, unrestricted ingress and egress under, over, and across
<br />such land for the purpose of exercising the rights herein granted, to excavate and refill ditches and
<br />trenches, and the right to clear and keep clear of trees, roots, brush, hedges, undergrowth, and other
<br />obstructions from the surface of such tracts interfering with the location, construction, inspection,
<br />repair, replacement, removal, and maintenance of such utilities. Any such utilities and
<br />appurtenances placed upon, over, and under such tracts of land shall remain the property of the
<br />Grantee and may be removed or replaced at any time.
<br />The Grantors for themselves, their heirs, devisees, executors, administrators, grantees and
<br />assigns hereby covenant that no building or structure shall be erected or permitted on said tract
<br />without obtaining the approval of the Director of Public Works for the City, provided, that the
<br />Grantors reserve the right to place, construct, and maintain grassed lawns, concrete driveways or
<br />parking lots, fences, poles, or other similar obstructions, not including trees, bushes, hedges, or other
