200101705 <br />or improvements in or on the leased premises that it may deem <br />necessary or desirable for its purpose; provided, however, the <br />Lessee shall first have submitted plans of the proposed alterations <br />or improvements to the Lessor and shall have received written <br />approval for the making of such alterations or improvements. <br />All such improvements and alterations to the leased premises <br />made by Lessee shall be and remain the property of the Lessee, <br />including any fixtures attached to the leased premises. Should <br />the Lessee desire to make any such alterations or improvments <br />and receive the written approval for the same from the Lessor, <br />the Lessee shall, prior to making the same, indemnify the Lessor <br />against mechanics or materialman's liens and shall make all such <br />alterations or improvements in accordance with all requirements <br />of law and local regulations and in such a manner as not to weaken <br />the structural strength of any building on.the leased premises. <br />Redecoration of the interior of the premises shall be done by <br />Lessee at its expense at such times as redecoration becomes reasonably <br />necessary. The Lessee agrees to maintain the leased premises <br />in a good and tenantable condition at all times. <br />8. Lessee to Comply with Laws and Ordinances of the City <br />of Grand Island. The Lessee agrees that it will use and occupy <br />said premises in a careful, safe, and proper manner, and will <br />not commit or suffer any.waste thereon. Further, the Lessee <br />agrees that it will obey and follow all laws of the State of <br />Nebraska and of the Ordinances of the City of Grand Island regulating <br />its use of said premises. <br />9. Damage or Destruction of Building By Fire During Term <br />of the Lease. If the building to be constructed by Lessee on <br />the premises herein leased to the Lessee shall be destroyed or <br />damaged by fire or by the elements, after the beginning of the <br />term hereof, and after occupation of the premises by the Lessee, <br />the Lessee shall repair or rebuild such building, or shall remove <br />the same from the premises. If Lessee fails so to do Lessor <br />may remove the building without any liability to Lessee and Lessee <br />shall pay Lessor the reasonable expenses of such removal. If <br />the building is removed by Lessee or Lessor this Lease shall <br />terminate forthwith. <br />10. No Change in Lease Agreement Except in Writing. It <br />is agreed that no change or changes shall be made in this Lease <br />Agreement except by writing signed by the parties hereto, setting <br />forth the terms of the agreed modification. <br />IA.. Waiver of Condition or Covenant by Lessor. No waiver <br />of i:.i.y condition or covenant of this Lease by Lessor shall be <br />deemed to imply or constitute a further waiver by Lessor of any <br />other condition or covenant under this Lease. The rights and <br />remedies created by this Lease Agreement are cumulative, and <br />the use of one remedy shall not be taken to exclude or waive <br />the right to the use of another. <br />12. Peaceable Enjoyment of Premises by Lessee. Subject <br />to the terms and conditions and covenants of this Lease, the <br />Lessor agrees that Lessee shall and may peaceably have, hold, <br />and enjoy the leased premises above described, without hindrance <br />by Lessor. At the expiration of this Lease, Lessee shall without <br />demand, quietly and peaceably deliver up possession of the demised <br />premises in as good condition as they shall be at the time of <br />occupancy of the premises by Lessee, normal wear and tear and <br />decay and damage by the elements alone excepted. <br />13. Termination. This lease shall terminate upon the first <br />of any of the following events: <br />-2- <br />
