200002239 <br />I. Other buildings and uses accessory to any of the aforesaid permitted uses. <br />J. Construction, operation, maintenance and reconstruction of an interstate roadway. <br />including, but not limited to, a lighted interchange and four lane divided roadway. <br />IV. EASEMENT ADNIINISTRATION <br />A. This easement shall be managed and administered by Holder. <br />B. The Holder may enforce all the terms and conditions of this easement, along with all <br />rights and power reserved in this easement, through such general or specific <br />regulations or orders as have been, or may from time to time be, promulgated under <br />its general governmental authority. <br />C. Grantor shall pay all regular and special real estate taxes levied upon the subject land. <br />V. GENERAL PROVISIONS <br />A. The agreed upon purpose of this easement is the protection of these lands from <br />commercial and industrial development, including but not limited to access roads, <br />commercial or industrial development across the land, mining or extraction of sand, <br />gravel or other minerals, and the use of lighted signs annually during the period of <br />February 1 through May 31. This agreement is not meant to affect the installation, <br />operation and maintenance of lighted informational, regulatory or traffic control signs <br />located within the right -of -way of Interstate 80. Any ambiguities in this easement <br />shall be construed in a manner which best effectuates preservation and protection of <br />the existing crane and other wildlife habitat. <br />B. Any subsequent amendment or repeal of any federal or state law, order, or regulation <br />shall not affect the rights reserved by Holder, its successors and assigns. <br />C. Holder, its successors and assigns, shall have the right to make studies or surveys, <br />take photographs, prepare such documentation, and undertake such monitoring in the <br />future as may be necessary or desirable to administer the provisions of this easement. <br />Any such map, plat, or other suitable document may be recorded in the land records <br />of the respective county in which the property is located. Any entry upon Interstate <br />80 right -of -way must be approved by the Nebraska Department of Roads. <br />D. The easement reservation alone does not authorize public entry upon or use of these <br />lands. <br />E. Grantor and invitees may hunt, fish, and trap on these lands in accordance with <br />applicable federal, state, and local game and fish regulations. <br />F. It is understood and agreed that this grant of perpetual conservation easement imposes <br />no other obligations or restrictions upon Grantor and that neither Grantor, nor <br />Grantor's successors and assigns, nor any other person or party claiming under them, <br />shall be restricted in any manner from utilizing the subject land in the customary <br />manner for agricultural purposes or for public highway purposes except as herein <br />provided. <br />Page 3 of 5 <br />
