200002238 <br />Subject, however, to all valid existing rights -of -way for highways, roads, railroads, <br />pipelines, canals, laterals, electrical transmission lines, telegraph and telephone lines, cable lines, <br />and all outstanding mineral rights heretofore conveyed to other parties. <br />The conveyance hereunder shall be effective upon the date of the acceptance of this grant <br />of perpetual conservation easement by the execution hereof of Holder's duly authorized <br />representative following concurrence by the Hall County Board of Supervisors; provided, <br />however, that such acceptance must be made within six (6) months of the execution hereof by <br />Grantor, or any subsequent date as may be mutually agreed upon in writing by the parties hereto, <br />and provided further, that in the event such acceptance is not made within the time agreed upon, <br />this conveyance shall be null and void. <br />II. COVENANTS OF GRANTOR <br />A. No commercial or industrial development shall be allowed on the land subject hereto. <br />This includes a prohibition on (1) the construction of access roads to commercial and <br />industrial development across the land; (2) the mining or extraction of sand, gravel or <br />other minerals; and, (3) the establishment of public or private firearms ranges. <br />B. Except for necessary informational, regulatory, and traffic control signs erected within <br />the right -of -way for Interstate 80, lighted signs erected on easement land may not <br />exceed thirty square feet in size and shall not be lighted during the period from <br />February 1 through May 31. Any sign must also comply with applicable federal, state <br />and local laws and ordinances. <br />C. Any signs erected within the highway right -of -way shall comply with the Manual for <br />Uniform Traffic Control Devices. <br />III. PERMITTED USES <br />Irrespective of this grant of easement, Grantor shall have the continuing right to use the <br />land, as follows: <br />A. For general agricultural purposes, including, but not limited to, plowing, discing, <br />planting and raising field crops, chemical fertilization, chemical pest and weed <br />control, irrigation, livestock grazing, grasslands, haying, and other similar <br />horticultural and open space uses. <br />B. Other customary agricultural uses, excluding livestock feed yards and accessory uses. <br />C. The construction of single family dwellings, restricted to one dwelling per 20 -acre <br />area or greater. <br />D. Living quarters for persons regularly employed on the premises but not including <br />labor camps or dwellings for transient labor. <br />E. Guest buildings not rented or used as a business. <br />F. Customary home occupations. <br />G. Buildings, corrals, stables, or pens, insofar as they are consistent with any of the <br />aforesaid permitted uses. <br />H. Offices incidental to the aforesaid uses. <br />Page 2 of 5 <br />
