<br /> C�mpliance W'r#h Environmental Laws. Trustvr represen�s and warrants #o Lend�r that: �1} Dur�ng the period o�
<br /> Trus#or's awnership of�he Pr�perty,there has heen no use,generatian, manufac�ure,storage,trea�ment,dispo�al,
<br /> release or threatened release❑� any Mazardous �u�stance by any persvn on, under, a�out or�rom fhe Praper-ty;
<br /> ��� Trustor has no knowledge af, ar reason to helieve tha�there has been, excep�as �reviaus�y disclosed �o and
<br /> a�knvwledged by Lender in writing, �a} any.b�each vr vinlativn ❑f any En�irvnmental La�rvs, �b} any use,
<br /> genera�ian, manufacture, storage, trea�ment, disposa�, release or threa�ened release vf any Hazardaus 5ubs�ance
<br /> on, under, about ar fram the Property by any prior awners o�r occupants ❑f the P�-�perty, ❑r �c} any ac�ual ❑r

<br /> Subs�ance❑n, under, abvut or from the Pr�perty;and �b} any such aGti�ity shal! be conducted in compliance w�th
<br /> a!I appli�able federa�, state, and la�al laws, regufations and ardfnances, including without limi�atian all
<br /> En�i�onmental Lav►rs. Trustar authorizes Lender and its agents to en#er upon �he Praperty to make such
<br /> insp�ctions and t�s�s, at Trustvr's expense, as Lender may deem apprapriate �o determine campliance Qf the
<br /> Property vWith this sectivn af the Deed vf Trust. Any inspectians or tests made by L,ender shall be fvr Lender's

<br /> �o any other pers�n. The representa�ions and warran��es �ontained here�n are based�n Trustor's due d�ligence in

<br /> Nuisance, 1Nas�e. Trustor shall nvt cause, canduc# or permit any nuisance nor commit, permit, �r suffer any
<br /> stripping of��-waste an vr ta the Prvper�ky vr any porti�n vf fhe Proper�y. Vllithvut limiting �he �enerality of the
<br /> foregoing, TrustQr will not rema�e, or grant�a any other party the righ�tn remave, any�imber, minerals �including
<br /> oil and gas},coa�,Glay, scoria, svil, �ravel ar rack produc�s wi#hvut Lender's privr written Gvnsent.
<br /> RemoWal of Imprv�ements. Trustor shall nat demv[ish ar remn�e any Impr��emen�s fr�m the Reaf Property w�thau�
<br /> Lender's Rri�r wr�tten consent. As a condi�ion to the rerna�al of any I mpra�emen�s, Len�er may require Trus'�or�o
<br /> make arrangements satisfactnry to Lender ta rep�ace such Impro�ements with lmprovemen�s vf at least equal
<br /> value.
<br /> Lender's Right to Enter. Lender and Lend�r's agents and r�presenta����s may�nter upan �he Real Prvperty at al�
<br /> reasanable times to att�nd to Lender's interests and ta inspec� th� Real proper�y for purposes a� Trustor's
<br /> cnmpliance wi�h the terms and Ganditions of this Deed o�T�-ust.
<br /> Gampliance with Gv�ernm�ntal Requ'rrernents. Trustv� sha�# pramptly c�mply wi�h alf laws, ordinances, and
<br /> regulatinns, now ❑r h�reaf�er in effec�, of all ga�ernmentaI authariti�� appfica�le to the use or occupanGy Qf the
<br /> Property, in�luding without lim�tatian, the Americans V1I�th Disabifities A�t. Trustor may cantest in goad faith any
<br /> such law, o�dinartce, ❑�- �e�uia�i�r� and wtthhold comp�iance du�-�ng any pro�ee�iing, inclu�iing appropriafe appea�s,
<br /> sv�an�as Trustvr has notified Lend�r in writing pr�ar t❑ doing sv and sv lang as, in L�nder's sole opinian, Lender's
<br /> �n�erests in the Praperty are no�jevpardized. Lender may requi�-e Trustar to post adequate secur��y Qr a sureiy
<br /> bond, reasonably satis�actary to Lender,�a protect Lend�r's in�e�-esfi.
<br /> Du�y to Pratec�. Trustor agrees neither t❑ abandon or lea�e unattended �he Prope�ty. Trustvr shall da all other
<br /> acts, �n additian t❑those acts s��fc�rth abo�e in this section,whi�h fram the charac�er and use of the Property are
<br /> reasonably necessary�v prvtect and presenre the Rroper�y.
<br /> TA�CES AN❑ LIENS. �he follawing pro�isions �ela�ing ta the taxes and li�ns an �he Propetty a�e pa� of this Deed of
<br /> Tr'ust:
<br /> Payment. Trus�vr shall pay when due�and in�I�events priar�o�ielinquency}all�axes, special taxes, assessments,
<br /> charges �in�luding wat�r and sev+rer}, fines and �mpvsi�ians I��ied against ar Qn accvunt��the Praperty, and shal�
<br /> pay when due all claims for work done ❑n flr f�r senrices rendered ar materia� �urnished t❑ �he Property. Trustor
<br /> sha�i maintain the Proper�y�r�e of ali lien�having pri�rity over vr equa�t�the interest❑f Lender under this Deed afi
<br /> Trus�, except fvr �he lien of ��xes and assessments not due, excep� far the Existing lndebt�dness refer�-ed to
<br /> below,and ex�ept as otherwise pro�ided in�his De�d v�Trust.
<br /> Right ta Gontes�. Trustar may w�thhold payment❑f any�ax, assessment, ar claim in c�nnec�ivn with a gnad faith
<br /> dispute o�e�the abliga�ion to pay, sQ Inng as Lender's in�er�st�n�he Pr�perty is nat�eopardiz�d, i�a lien arises vr
<br /> is filed as a resul�o� nonpayment, Trustflr shall within fift�en �'15} days af�er the lien arises ar, if a �ien is filed,
<br /> within fifteen �'!5} days after Trus�or has no�ice ❑f�he fi�ing, secure�he discharge of the lien, ar if requested by
<br /> Lender,deposit with Lender��ash�r a suf�icient corpora�e sur�ty band❑r other security satis�actory t� Lender in an
<br /> amvun#suffi�ient t❑ dischar�e the lien plus any�osts and attorneys'f�es, ❑r o�her Gharg�s�ha��ould ac�rue as a
<br /> result of a fareclosure or saie und�r the�ien. �n any contest, Trust�r shall de�end ifself and Lender and shall satisfy
<br /> any adv��se�u�igment before enforcement a�ainst the P�aperty. Trustor s�a�I name Lende�as an additional❑bligee
<br /> under any surety bond furnished in�he cantest proceedings.
<br /> Evidence ❑f Payment. Trusta�r shall upan demand furnish ta L�nder satisfac�c�ry��idence of payment of�he taxes
<br /> �r assessm�nts and sha�� authorize the appropriate go�ernmental officia!ta deli�er�a Lender at any time a written
<br /> statement vf the taxes and assessments against�he Praperty.
<br /> Notice af Construction. Trustor shall noti�y Lender at least fifteen �'�5} days befare any w�rk is commenced, any
<br /> services are furnished, a�any materials are supplied tv #he Prvp�rty, if any mechanic's lien, ma�erialmen`s lien, or
