200101211 <br />1. Durability: By this instrument, Principal creates and <br />establishes a durable and general power of attorney upon the <br />following principles: <br />a. Legal Sources: The authority and power within the <br />scope of this instrument derive their validity from and <br />compromise and constitute a durable power of attorney <br />under the provisions and within.the meaning of Sections <br />30 -2664 through 2672, Reissue Revised Statutes of <br />Nebraska, 1943, as amended, and all other applicable <br />provisions of the Nebraska Uniform Durable Power of <br />Attorney Act, as amended, and the Nebraska Probate Code, <br />as amended; and the short form expressions herein used <br />have the respective meanings thereto ascribed by and are <br />respectively subject to application, construction, <br />enforcement, and interpretation as prescribed under the <br />provisions of Sections 49 -1501 through 1561, Reissue <br />Revised Statutes of Nebraska, 1943, as amended, and all <br />other applicable provisions of the Nebraska Short Form <br />Act. <br />b. Continuation: No authority or power within the scope <br />of this instrument is affected by any disability of <br />Principal or any uncertainty as to the death- of <br />Principal; and this instrument continues to be effective <br />and operative after the death of Principal unless and <br />until Agent has, by notice thereof or otherwise, acquired <br />actual knowledge of the fact of such death. <br />c. Termination: The authority and power within the <br />scope of this instrument terminates and this instrument <br />ceases to be effective and operative, at or after the <br />death of Principal when, by notice thereof or otherwise, <br />known to Agent or, if sooner, upon its revocation by or <br />for Principal. <br />2. Plenary Power: By this instrument, Principal confers <br />upon and grants to Agent, without limitation of the generality <br />thereof, Plenary Power exercisable in the absolute discretion and <br />judgment of Agent. <br />IN WITNESS WHEREOF, Principal has executed this instrument at <br />Grand Island, Hall County, Nebraska, on the /_ day of March, <br />1996. <br />ESSIE MARIE PIERCE-, Principal <br />2 <br />
