2 <br />2©1507161 <br />Parcel B pursuant to its normal circular rotation; and Dethloffs have agreed to grant a permanent <br />easement to allow Codners access over and across a portion of Parcel B for the purpose of the normal <br />operating of said center pivot irrigation system that will cause the spraying of water and chemicals <br />onto Parcel B. <br />NOW, THEREFORE, in consideration of the defining and clarification of the exact location <br />of this ingress- egress easement, Codners do hereby grant and convey to Dethloffs, their heirs, <br />personal representatives, successors and assigns, a permanent non - exclusive ingress- egress right -of- <br />way for the purpose of providing access to Parcel B, said easement to be located on, over and across <br />the following described portion of Parcel A: <br />A twelve foot wide strip of land located on Parcel A, with said strip of land <br />being the twelve (12) feet North of a line beginning at a point being 143.24 feet <br />North of the Southwest corner of the North Half of the North Half of the <br />Southwest Quarter (NY2N %SW %) of Section Twenty -one (21), Township Nine <br />(9) North, Range Twelve (12) West of the 6 P.M., Hall County, Nebraska; <br />thence N 87 °38'04" E, a distance of 187.91 feet; thence S 52°41'51"E, a distance <br />of 86.99 feet; thence S 10 °58'54 "E, a distance of 35.25 feet; thence N81 °00'33 "E, <br />a distance of 45.23 feet; thence N38 °28'25 "E, a distance of 17.20 feet; thence <br />N 76 °19'18" E, a distance of 12 feet to its ending point. <br />NOW, THEREFORE, in consideration of the defining and clarification of the approximate <br />location of the electrical utility line easement, Dethloffs do hereby grant and convey to Codners, their <br />heirs, personal representatives, successors, and assigns, a permanent ingress- egress right -of -way in, <br />over, across, under, upon and through the following described real property for the purposes of <br />operating, using, replacing, repairing and maintaining the existing electrical utility Line and <br />appurtenances thereto for the purpose of providing power to the irrigation well and power unit or <br />electric motor located on Parcel A, together with the right of access to said easement for said <br />purposes: <br />A 15.0 foot wide strip of land located across part of Parcel B, with said strip of <br />land being 7.5 feet on each side of the following described centerline: Referring <br />to currently existing electrical power pole located approximately 55 feet North <br />and 40 feet east of the Southwest corner of Parcel B and near the westerly <br />boundary of Parcel B; thence running in a generally east northeasterly direction <br />approximately 134 feet to a currently existing power pole located approximately <br />96 feet North of the South boundary of Parcel B; thence continuing in a <br />generally easterly direction to the electrical power pole at the irrigation well and <br />power unit located on Parcel A. The side lines of the aforedescribed easement <br />to be extended or shortened as necessary to provide reasonable access for the <br />purpose of operating, maintaining, repairing, and replacing the electrical utility <br />line and to provide power for the proper use and operation of the irrigation well <br />and power unit located on Parcel A. <br />NOW. THEREFORE, in consideration of the establishment of an irrigation pivot system <br />easement and the clarification of this agreement and understanding of the parties, Dethloffs does <br />hereby grant and convey to Codners, their heirs, personal representatives, successors and assigns, a <br />permanent easement for center pivot irrigation purposes to allow Codners with ingress and egress <br />access to cross over and spray irrigation water and agricultural related chemicals on the applicable <br />portion of Parcel B. Further, it is agreed by Dethloffs that Dethloffs shall not build any permanent <br />structure or structures on Parcel B which will prevent the operation of the center pivot irrigation <br />
