Box 790 <br />Grand Island, NE 68802 <br />WITNESSETH: <br />1 <br />A part of the Northeast Quarter of the Northeast Quarter (NE 1 /4 NE 1/4) of <br />Section Twenty One (21), Township Eleven (11) North, Range Nine (9) <br />West of the 6 P.M., Hall County, Nebraska, described as follows: <br />Commencing at the Southwest corner of the intersection of Anna and <br />Eddy Streets, which streets are now established and in use, thence <br />Southwesterly along the South boundary of Anna Street, a distance of <br />16+.4 feet, thence Southeasterly at right angles, a distance of 140,0 feet; <br />thence Northeasterly at right angles, a distance of 164.4 feet; thence <br />Northwesterly along the Westerly boundary of Eddy Street, a distance of <br />140.0 feet, to the place of beginning; said tract being a rectangular tract, <br />having a frontage of 140.0 feet on Eddy Street, and a frontage of 164.4 <br />feet on Anna Street, all in the City of Grand Island, Hall County, Nebraska <br />r-, <br />AGREEMENT TO WAIVE DUE ON SALE OR TRANSFER PROVISIONS <br />THIS AGREEMENT is made and executed this 14th day of September, 2015, by <br />and between EXCHANGE BANK, hereinafter referred to as "Lender ", and DONALD D. <br />MEHRING, hereinafter referred to as "Borrower ". <br />WHEREAS, Borrower did on December 12, 2014, execute and deliver to Lender <br />a Deed of Trust to secure indebtedness in the original principal amount of One Hundred <br />Eighty -Eight Thousand and No /100 Dollars ($188,000.00), which Deed of Trust was <br />recorded on December 12, 2014 as Instrument No. 201407835 in the records of the <br />Office of the Register of Deeds, Hall County, Nebraska ( "Deed of Trust "); and <br />WHEREAS, the Deed of Trust permits acceleration of the indebtedness owing to <br />Lender at the option of the Lender in the event of a sale or transfer of interest in respect <br />to any portion of the real estate thereby secured; and <br />WHEREAS, Borrower desires to effectuate a transfer of legal title to the real <br />estate described in the Deed of Trust; subject and subordinate, however, to remaining <br />indebtedness owing to Lender; and <br />WHEREAS, in addition to the collateral afforded by the continuing first lien in <br />favor of Lender upon the real estate hereinafter described, Borrower shall continue to be <br />obligated to Lender upon the indebtedness secured by such real estate, notwithstanding <br />the transfer to be made by Borrower; and <br />WHEREAS, Borrower has advised Lender of its intent to convey its record title <br />interest in that real estate described as: <br />subject to the continuing lien in favor of Lender evidenced by the Deed of Trust and has <br />requested a waiver of such due on sale or transfer provisions; and <br />WHEREAS, Lender is willing to consent to such transfer and waive any right to <br />accelerate indebtedness yet owing to Lender conditioned upon the continued liability of <br />
