<br /> 2�. Hazardaus Su�stances. As used in �his 5ection 21: �a} "Ha�ardous Su�stan��s" are those
<br /> substances defined as �oxic �r hazardous subs�ances, pvllutants, ar wastes by Environmental Law
<br /> and the f�ll�wing substances: gas�line, k�rosene, other��ammable or toxic petro�eum pra�ucts, �ox�c
<br /> pesti�ides and herbicides,vvlatile svl��nts,mat�ria�scvnfaining asbestos or�orrnaldehyde,and r�dioacti�e
<br /> materials; �b}"Environmental Law" means federa� laws and laws of the jurisdiction where�he �rop�rty
<br /> �s Ivca�ed that re�ate to health,safety�r en�irvnm�ntal pratecti�n; �c}"En�ironmentai��eanup"in�lude�
<br /> any res�onse action, remedial action, �r removal action, as defined in En�ironmen�al Law; and �d} an
<br /> "Environmenta� Condition" means a cvndition that can cause, con�ribute to, vr o�herwise trigger an
<br /> E n�ironmenta� �ieanup.
<br /> Borrowe�shall nvt cause ar permit the presence,use,d�sposal,storage,or releas�of any Hazardaus
<br /> Substances, or threat�n to rel�ase any Hazardous Substanc�s, on �r�n �he Prap�r�y. Barr�wer shall
<br /> not do, nor allow any�n� else t� dv, anything afFecting the Property �a� that is in violat�vn o� any
<br /> En�ironmental Law, ��}which creates an EnWi�onm�ntal �ondition, or�c�which, due t�the presence,
<br /> use, �� release �f a Ha�ardvus Substance, cr�ates a �on�lition that advers�ly affects the Wa{ue �f the
<br /> Property.The pre�eding two sentences sha�� n�t apply to�he presence, use, ar starage an#he Praperty
<br /> af small quantities of Hazardous Substances that are generally recognized ta be appropriaf�to na�mal
<br /> residential uses and ta maintenance af the Prop�rty�inclu�ing, but nat limited tv, hazardous substanc�s
<br /> in consu mer p�od ucts}.
<br /> Borrawer shail pramptly gi�e Lender written notice of�a}any in�es�igati�n, cla�m, demand, lawsu��
<br /> ar ather actian by any g�vernmenta� or regula�ory agency ar private party in�o���ng the R�operty and
<br /> any Hazardaus �uhstanG� ar En�ir�nm�ntai Law vf which Bv�raw�r has a��ual kn�w�edge, �b} any
<br /> En���anmen�al �andition, including but nvt limited to, any spil��ng, leak�ng, discharge, r�lease�r threat
<br /> of���ease of any Hazardous Substance, and �c�any canditian caused by the�resence, use ar release
<br /> of a Haza�dous Subs�an�e which adverse�y aff�cts the va�ue of the Property, If Borrower learns, or is
<br /> notif�ed by any go�ernmental o� regu�atory autha���y, or any p��Wat� party, that any removai or other
<br /> remedia�ian vf any Ha�a�daus Substance aff�cting the Pro�erty is necessary, Bvrrow�r shall pramptly
<br /> take all necessary remedial ac�ions in accordance with Environmenta� Law. No�hin� herein shall creat�
<br /> any abligatian on Lender for an Envir�nmen�al Cleanup.
<br /> N�N-UNIF�RM ��VENANTS. Borrawer and Lender further cv�enan�and agree as folfvws:

<br /> �tirne required by Appli�able Law,Truste�sha�l giv�pu�lic natice of sale ta th�persans and in�he
