<br /> �7. ENVIR�NMENTAL LAWS AND HA2aRD�US 5UB5TANCES.A�u�ed in th is section,�1}
<br /> Enviranmental Law rneans,without limitation,the Camprehensi�e En�ironmental Respanse.Campensati�n
<br /> and Liabili�y Act�CERCLA,421J.5.C.9fi�I et s�q.�,and all other federal,state and loca�laws,regulations:
<br /> ordinances,cvurt orders,atto�ney general opinions or interpreti�e letter��aneerning th�publi�health,safety,
<br /> we�fare,en�ironment or a hazardou�substan�e;and���Ha�ardous Substance means any taxi�,radioacti�e or
<br /> hazardous rnaterial,waste,pvllutant or contaminant wh�ch has eharacteristics which render the substan�e
<br /> dangervus or potentially dangerous to the public health,safety,welfare or en�irvnrnent.The term includes,
<br /> without lim�tatian,any substan�es defined as"hazardou�material,""tvxi�substan�es,""hazardaus waste"or
<br /> "hazardous substance"under any En�irnnmental Law.
<br /> Trusto�represents,warrants and agree�that:
<br /> A. Extept a5 previous�y dist�osed and acknowledged in writing to Beneficiary,nv Hazardvus 5ubstance is
<br /> or will be located,stored or released vn or in the Property.This res#riction d�es not app�y to srnall
<br /> quantities of Hazardaus Substan�es that are generally recognized ta be apprvpriate for the normal use
<br /> and rnain�enance of the Property.
<br /> B. Exeept as previ�usly disciosed and a�knowledged in wrEting to Beneficiary,Trus�ar and e�ery tenant
<br /> ha�e been, are, and shail remain in fu�1 compliance with any appli�able EnWironmental Law.
<br /> C. Trustar shall immediately notify Beneficiary if a�elease or threatened release of a Hazardous Substan�e
<br /> ❑eeurs on,under or abaut the Praperty❑r there is a��iolation of any En�ironmenta�Law eoncerning the
<br /> Property.In such an e�en�,Trustor shall take all necessary remedial action in a��ordan�e with any
<br /> En�ir�nrnental Law.
<br /> D.Trustor shali immediateky notify Benefi�iary in w�iting a�svan as Trustar has reason to b�lie�e there is
<br /> any p�nding ar thr�atened fnvestigation,c[airn,or praceeding relating to the release�r threatened
<br /> re�ease of any Hazardous Su�stance or the�io�ation of an�En�ir�nmental Lavv.
<br /> 18. C�NDEIV�NATI�N.Trustor will give Beneficiary prornp�notice of any pending or threatened action,by
<br /> pri�ate or pub�ic entit�es to purchase or take any or al1 of the Property through c�ndernnatifln,eminent
<br /> domain,ar any other mean�.Trustar authoriz��Benefi�+ary to intervene in Tru�tar's name in any of the
<br /> a�ove described actions ar�lairns.Trustor as�igns to Beneficiary the pro�eed5 of any award vr claim fvr
<br /> damages Canne�ted with a condemnation ar othertaking of all or any part ofthe Property.5uch proceeds
<br /> �hall�e�onside�ed payrnents and wil�be applied as pro�ided in th�s 5ecurity Instrument.This a�signmen�of
<br /> pro�eeds is subje�t ta the terms af any priar rnortgage,deed of trust,security agre�rnent or other lien
<br /> document.
<br /> 19. INSURANCE.Trustar shall keep Property insured against Ioss by fire,flood,theft and other hazards and
<br /> risks reasonably associated with the Property due to its type and Iocation.This insuran�e shall be maintained
<br /> in the amounts and for the periads that gen�ficiary requires.What Beneficiary require5 pursuant tv the
<br /> pre�eding twa sentences can�hange during the term of the Se�ured Debt.The inSurance carrier pra�iding the
<br /> insuranee shall be�hosen by Trustar subje�t to Benefi�iary's appra�al,whi�h sha[�not be unreasonably
<br /> withheld.lf Trustor fails tv maintain the co�erage d�s�ribed aba�e,genefi�iary may,at 6eneficiary's optivn,
<br /> obtain�overage to pratect Beneficiary's right�in the Praperty according to the terms of this 5�curity
<br /> Instrument.
