200001428 <br />2.3 OPERATIONAL EXPENSES. The Tenant will assume daily <br />maintenance of all irrigation equipment. The Tenant will supply <br />all the equipment for planting and harvesting of the crops. The <br />Tenant shall furnish all labor and expenses for the operation of <br />the farm. The Tenant shall be responsible for the costs for the <br />purchase and application of all fertilizer, insecticides and <br />herbicides. Major repairs to the irrigation well, pump, and motor <br />not caused by the neglect of the Tenant shall be paid by the Owner. <br />The Tenant shall furnish the labor necessary to keep the fences, <br />domestic and stock wells, in good repair and condition. The Owner <br />shall pay the cost of materials used in keeping the fences, <br />domestic and stock wells in good repair and condition. Tenant <br />shall pay for all cost of power for operation of the irrigation <br />equipment. Tenant shall pay to Owner cash rent in the amount of <br />$1,000.00 on or before December 31, 1998, for the use of the <br />irrigation pivot located upon the real estate. <br />2.4 GOOD HUSBANDRY. The Tenant will operate the property in <br />an efficient and husbandlike way, will do the plowing, seeding, <br />cultivating, and harvesting in a manner that will conserve the <br />Owner's property. Tenant shall be entitled to remove the stalks by <br />mechanical means but shall not be permitted to pasture live stock <br />for consumption of stocks in the field. Tenant shall pay all costs <br />for seed and other costs including, but not limited to, ground <br />preparation and planting of the crops. Tenant must comply with the <br />following actions for good husbandry of the property: <br />(a) Corn must be planted on or before May 1, 2000. <br />(b) Soybeans must be planted on or before May 15, 2000. <br />(c) Tenant must follow the instructions of a crop <br />consultant retained by the Owner for the application of herbicides, <br />insecticides and fertilizer. <br />(d) All crops must be harvested by November 1, 2000. <br />If Tenant fails to comply with the terms of Subparagraphs (a) <br />through (d) of this Paragraph 2.4 causing Owner to sustain damages, <br />Tenant is liable for the payment of the damages to Owner for <br />failing to comply with Subparagraph (a) through (d) of this <br />Paragraph 2.4. <br />2.5 WASTE. The Tenant will not commit waste on or do damage <br />to the property and will use care to prevent others from doing so. <br />2.6 NOXIOUS WEEDS. The Tenant will use diligence to prevent <br />noxious weeds from going to seed on the property and will destroy <br />the same, and will keep the weeds and grass cut or destroyed in the <br />fields, farmstead, roadside and fence row. <br />2 <br />
