<br /> agreeinent between Lender and the Secretary, unless e�plicitly authorized to clo so by Applicable Law.
<br /> 21. Hazardaus Substances. As usecE in this Section 21: (a) "Hazardous Substances" are those substances
<br /> defiixecl as toxic or haznrdous subatances, pallutAnts, or wastcs Uy�nviroiuncntal Law aud the followii�g
<br /> suhstances: gasoline, kerosene, other flammable or toxic petroleurn products, toxic pesticides�nd
<br /> herbicides, volaYile solvents, materials containing asbestos or formaldehyde, and radioacfive inaterials;
<br /> (b}"Bnvirontnental Law" means federal laws and laws of the jurisdiction where the Property is located
<br /> that relate to health, safety ar environmental protection; {c)"EnvirotunenYal Cleamep" it�cludes any
<br /> response action, remedial action, or removal action, as defined in Bnvirontnet�tal Law; and(d}an
<br /> "�nvironmental Condition" �neflns a condition that can causc, coutributc to, or othcrwisc trigger an
<br /> l;nvironmental C1�anup.
<br /> Borrowar sha11 not cause o3•�ec�cnit tl�e preseiice, use, tlisposal, siorage;, or rele�se of�uiy IIa�ardous
<br /> Substances, ar tlueaten to release an5�Hazardous 5ubsfances, on or in the Property. Borrower shail not
<br /> do, nor allow anyone else ta do, anything affecting the Property{a)that is in violation of an.y
<br /> Environmental Lav�r, {b)whicli creates an�n�irotunental Condition, or(c)which, due to the presence,
<br /> use, or release of a Hazaedous Substance, cr�ates a condition that adversely affects the value of the
<br /> Property, The preceding two sentenet;s shall not apply to the presence, use, or storage on the Propert5r of
<br /> small Quantities of I-Iazarc�ous Substances that are generally r�cogriiced�o be dppropria�e lu normal
<br /> residential uses and to inaintienance of the Property(iz�cludir�, but not liinited to, hazardous subst�nces
<br /> in consumer products).
<br /> Borrower shall promptly give Lcndcr writtcn noticc of(a)any invcstigation, claixn, demand, lav;+suit ar
