<br />John H. Bergmeyer, a member of the Nebraska State Bar Association, whose address is 800 Lincoln
<br />Square, 121 S. 13th Street, P.O. Box 82028, Lincoln, Nebraska 68501 -2028, Grantor, as trustee under that -
<br />certain Deed of Trust described below (the "Trust Deed "), for valuable consideration, hereby grants and
<br />conveys to AMERUS LIFE INSURANCE COMPANY, Grantee, without any covenant or warranty, expressed
<br />or implied, all of the following described real estate (as defined in NEB. REV. STAT. § 76 -201):
<br />The South Seventy- Eight and Ninety -Five Hundredths (78.95) Feet of Lot Eight (8), Block
<br />Five (5), Wiebe's Addition to the City of Grand Island, Hall County, Nebraska (the
<br />"Property ").
<br />This conveyance is made pursuant to the powers conferred on Grantor under that certain Trust
<br />Deed dated October 9, 1998, executed by Brenda J. Sisson, a single person, as Trustor, in which AmerUs
<br />Home Equity, Inc., an Iowa corporation ( "AmerUs "), is named Beneficiary, and filed for record on October
<br />16, 1998, as Instrument No. 98-110116, in the records of the Register of Deeds of Hall County, Nebraska.
<br />By executing the Trust Deed, the Trustor named therein granted and conveyed to the Trustee named
<br />therein, on the trust therein expressed, the Property to secure, among other obligations, payment of a
<br />promissory note of even date in the original principal amount of $50,000.00 and interest thereon in
<br />accordance with the terms set forth in said promissory note. AmerUs transferred and assigned to AMERUS
<br />LIFE INSURANCE COMPANY all right, title and beneficial interest of AmerUs as beneficiary under the Trust
<br />Deed pursuant to that certain Assignment of Deed of Trust filed for record on February 8, 1999, as
<br />Instrument No. 99- 101389, in the records of the Register of Deeds of Hall County, Nebraska (the
<br />"Assignment "). By and through AmerUs, its attorney -in -fact, AMERUS LIFE INSURANCE COMPANY, as
<br />the assignee under the Assignment and Beneficiary under the Trust Deed, executed that certain Substitution
<br />of Trustee, dated November 18, 1999, and recorded in the records of the Register of Deeds of Hall County,
<br />Nebraska on November 22, 1999, as Instrument No. 99-111186, and thereby named Grantor as the
<br />Successor Trustee under the Trust Deed. Grantor hereby sets forth the following recitals evidencing the
<br />compliance with and satisfaction of all requirements and conditions specified in the Trust Deed and arising
<br />under applicable law to authorize the conveyance of the property contemplated hereunder:
<br />A. The Trustor named in the Trust Deed defaulted on the obligations arising under the Trust
<br />Deed in the particulars set forth in the Notice of Default described below, and such default
<br />continued until the time of the sale of the Property.
<br />B. The Successor Trustee named above executed that certain Notice of Default dated
<br />November 19, 1999 and filed for record in the records of the Register of Deeds of Hall
<br />County, Nebraska on November 22, 1999, as Instrument No. 99-111187. Said Notice of
<br />Default was executed and filed for record in accordance with the requirements set forth in
<br />the Trust Deed and in accordance with all requirements arising under the Nebraska Trust
<br />Deeds Act. Copies of said Notice of Default were mailed in the manner and within the time
<br />required by the Trust Deed and the Nebraska Trust Deeds Act to all parties entitled thereto
<br />under the Trust Deed and the Nebraska Trust Deeds Act.
