Page 12 of 69 <br />201503252 <br />trustor shall be deemed to be the Owner. In the case of a Lot to which fee simple title is vested <br />in a trustee pursuant to a subdivision trust agreement or similar agreement, the beneficiary of <br />any such trust who is entitled to possession of the trust property shall be deemed to be the <br />Owner. <br />1.37 "Person" means a natural person, corporation, business trust, estate, trust, <br />partnership, association, limited liability company, joint venture, government, governmental <br />subdivision or agency, or other legal or commercial entity. <br />1.38 "Plat" means the initial subdivision intended to be part of the Community and all <br />amendments, supplements, and corrections thereto. <br />1.39 "Property" or "Project" means the real property, together with all <br />Improvements located thereon, described on Exhibit A attached hereto. <br />1.40 "Purchaser" means any Person, other than the Declarant, who becomes the <br />Owner of a Lot by means of a voluntary transfer, except for (a) a Person who purchases a Lot <br />and then leases it to the Declarant for use as a model in connection with the sale of other Lots; <br />(b) a Person who, in addition to purchasing a Lot, is assigned any or all of the Declarant's rights <br />under this Declaration; or (c) a Designated Builder. <br />1.41 "Recording" or "Record" means placing an instrument of public record in the <br />office maintained for recording documents affecting real property in Hall County, Nebraska, and <br />"Recorded" means having been so placed of public record. <br />1.42 "Regular Assessment" means an assessment levied pursuant to Section 9.2. <br />1.43 "Residence" means any building or portion of a building situated upon a Lot and <br />designed and intended for independent ownership and for use and occupancy as a residence. <br />1.44 "Resident" means each person occupying or residing in any Residence. <br />1.45 "Special Assessment" means any assessment levied pursuant to Section 9.3. <br />1.46 "Subdivision Assessment" means any assessment levied pursuant to Section 9.4. <br />1.47 "Subdivision Assessment Area" means a portion of the Project designated in a <br />Supplemental Declaration as an area containing Subdivision Common Areas or as an area in <br />which the Association will provide Subdivision Services. <br />1.48 "Subdivision Common Area" means any part of the Common Area that is <br />designated in a Supplemental Declaration as being for the sole or primary benefit of the Owners <br />and Residents of a particular part of the Project. Subdivision Common Areas may include, <br />without limitation, drainage or retention areas, landscape medians, and areas designated as parks. <br />1.49 "Subdivision Expenses" means the actual or estimated expenses, including <br />allocations to reserves, incurred or anticipated to be incurred by the Association for the <br />maintenance, repair, and replacement of Subdivision Common Areas or to provide Subdivision <br />Services to the Owners and Residents in a Subdivision Assessment Area. <br />
