20150303. <br />than three (3) in number. Side and lakeside yard fences shall not be constructed <br />of chain link, plastic or wooden materials. Smaller wooden or chain fences are <br />acceptable if they are built no farther than four feet (4') away from the residence. <br />16. No vines which restrict visibility shall be allowed upon the metal fences. <br />No hedges or other continuous plantings shall be allowed if they would thwart <br />the purpose of the fencing regulations which is to give Kenmare a general, open, <br />park -like appearance and view to and from the lake as well as along the street. <br />4. Paragraph 17 of Article II of said Declaration of Protective Covenants, <br />Restrictions and Conditions recorded as Document No. 92 -10147 on February 25, 1992, in the <br />Office of the Register of Deeds of Hall County, Nebraska, shall be deleted and replaced by the <br />following: <br />17. The Board of Directors of Kenmare Owners Association may adopt rules <br />which allow lot owners who construct swimming pools on their lots to protect <br />those pools with security and privacy fences or walls which do not comply with <br />paragraphs 15 and 16, above. However, those rules must apply uniformly to all <br />lots in Kenmare and must proscribe fences which would not materially obstruct <br />the view of the residence site on either adjacent lot to and from the lake. <br />5. Paragraph 6 of Article III of said Declaration of Protective Covenants, <br />Restrictions and Conditions recorded as Document No. 92 -10147 on February 25, 1992, in the <br />Office of the Register of Deeds of Hall County, Nebraska, shall be deleted and replaced by the <br />following: <br />6. The roof of the residence shall be covered with wooden shake shingles, <br />slate, concrete, tile or 50 -year life asphalt or fiberglass shingles. The Aesthetics <br />Committee must approve the color of the concrete, tile, slate, asphalt shingles and <br />fiberglass shingles. <br />6. Paragraph 9 of Article IV of said Declaration of Protective Covenants, <br />Restrictions and Conditions recorded as Document No. 92 -10147 on February 25, 1992, in the <br />Office of the Register of Deeds of Hall County, Nebraska, is amended to read as follows: <br />
