<br /> and place as Trustee designates. Trustee shall gi�e natice of sale including the tirne, terms a.nd place of sale
<br /> and a descriptian of the property to be sold as required by the appl�icable 1aw in effect at the time of the
<br /> proposed sa1e.
<br /> Upnn saie of the Property and to #he extent not prohibi�ed by law, Trust�� shali make and deliver a deed to
<br /> � th.e Prop�rty sold which con�eys absalute t�t1e to the purchaser, and after f rs# pa}�ing alI fees, charges and
<br /> cas�s, sha1l pay to B�ne�iciary atl moneys advanced for repairs, taxes, insuranc�, liens, assessm�nts aad prior
<br /> �ncumbrances and interest thereon, and the principa��and interest on�he Secured Debt, payi.ng �1ie surplus, if
<br /> any, to Trustar. �Benef�cxary may purchase �he Property. The re�itals in any deed of con�e�ance shall be

<br /> Al� remedies are distinct, cumulative and not exclusive, and �h� Ben�ficzary is entitled to a11 remedies
<br /> pra�ided at law or equi�y, vvhether ar not expressly set forth. The acceptance by Bene�ciary of any sum in
<br /> payment or partial payment on#he Secured Deb� aft�r th�balance is due or is acCeierated or after foreclosure

<br /> 16. EXPENSES; ADVAN�ES �N CQVENANTS; ATTQRNEYS' FEES; CDLLEeTIQN �OSTS. Except
<br /> when prohibited by lav�, Trustor agrees to pay alI of Beneficiary's expenses if Trustor breaches any cuv�na.nti
<br /> in this Security Instrument. Trustor will also pay on demand any amount incurr�d by Beneficiary f�r
<br /> � insuriulg, inspec#.�ng, preserving or otherwise protecting �he Prop�rty a.nd Beneficiary's securi�y interes�.
<br /> These expenses will bear in�er�st fram the date of th�payment until pa�d in ful� at�he highest interest rate in
<br /> effect as pravided in the terms of�he Secured Deb�. Trustor agrees �o pay all costs and expenses incurred by

<br /> a.nd Liability Act t�ER�LA, 42 U.S.C. 9G�1 et seq.}, and all other federal, state and�ocal �aws, regu�ations,
<br /> ordinances, �ourt orders, attorney g�neral opinions ar interpretive Ietters cancerni.ng th�public health, safety,
<br /> v��Ifare, environment or a hazardous substanc�; and ��} Hazardous Substiance means an� toxic, radioactiWe or
<br /> hazardous ma�erial, was�e, pallutan� or con � which has characteris�ics wluch rend�r the substance
<br /> dang�rous or potentially dang�raus ta the pubiic health, safety, we�fare �r envuonm�nt. The t�rm i.ncludes,
<br />� �vithout Iim�itation, any subs�ances de�ed as "hazardaus mat�rial," "toxic subs�ances," "ha�ardous waste" or
<br /> "hazardous su�stance"under any Environmental Law.

<br /> B. Except as previausly disc�osed and ackn�vvled�ed in v�riting to Beneficiaiy, Trustor and every t�nant
<br /> have been, are, and sha11 remain in fu11 compliance wi�h an�r app�icabie En�rironmenta�Law.
<br /> C.Trustor sha11 immediate�� notify B�neftciary if a rel�ase nr�hreatened release vf a Hazardous Substance
<br /> occurs vn, under or abvut the Property or�here is a violatxon af any Envxronmenta� Law concerning the
<br /> Property. In such an event, Trustor sha�l take a1� necessary remedial action in accordance with any
<br /> Envuonm�ntal Lavsr.
<br /> D.Trustar sha�l inanaediatel� n�tify Beneficiary in writing as soon as Trustor has reason to �elieve there is
<br /> an�r p�nding or threatened in�estigation, claim, or praceeding relating to tbe release vr threat�n�d
<br /> release of any Hazardous Substance or the violat�an vf any Environmenta�Law.
<br /> 18, C�NDEMNATI�N. Trustor wi�l gi�e Beneficiary prompt notice of any pendi.ng or threaten�d actian, by
<br /> pr�va�e or public enti�ies to purchase vr ta.ke any or all of t�ie Property t�rough condemnation, eminent
<br /> domain, or any other means. Trustor aut�orizes Beneficiary to intervene in Trustor's name in any of the
<br /> ahove described actions or c�aims. Trustar assigns to Benef ciary th� praceeds of auy avvard ar clai.m far
<br /> damages cvnnected with a candemnation �r other t.akt.ng af al� or any part of �he Property. Such prviceeds
<br /> shall �e considered payment5 and v��l� be appiied as pr�vided in t�is Security Instrument. This assignment of
