In accordance with the requirements and ordinances of the City of Grand <br /> Island, Hall County, Nebraska, all leveling and fine grading of lots after <br /> construction is completed is to establish and maintain grading that allows <br /> drainage to the front or street side of lot. No dirt from basement <br /> excavation shall be removed from property, but shall instead be <br /> incorporated into the final lot grading. <br /> 27. During construction, lot owners and builders are required to maintain the <br /> project and surrounding area in a tidy manner. Each owner shall be <br /> responsible for the proper storage and disposal of all construction <br /> materials and debris associated with the construction. No junk, rubbish or <br /> loose debris shall be left exposed on any lot. No trash fires will be allowed <br /> on any lot to dispose of construction materials or debris. The lot owner <br /> shall be responsible for the enforcement and monitoring of all contractors <br /> and suppliers performing work upon their lot. <br /> 28. Each owner shall be responsible for maintaining their landscaping in a <br /> neat and attractive manner on their lot. There shall not be cottonwood <br /> trees planted or allowed to grow on any lot. <br /> 29. All sidewalks shall be constructed to comply with the requirements of the <br /> building codes and ordinances of the City of Grand Island, Nebraska and <br /> shall be constructed no later than the time the home is built and earlier if <br /> required by building codes and ordinances. <br /> 30. If any owner of any lot or portion thereof, or his/her heirs or assigns, shall <br /> violate or any t to violate of the covenants, restrictions, or <br /> Y <br /> conditions set forth, it shall be lawful for any other person or persons <br /> owning real estate in said Subdivision to prosecute such proceedings at <br /> law or in equity against the person or persons violating or attempting to <br /> violate any such covenants, restrictions, or conditions and to prevent him <br /> or her from so doing, or to recover damages for such violations. <br /> 31. If any of the covenants, restrictions, or conditions <br /> herein set forth is <br /> Y , <br /> declared void by a court of competent jurisdiction, the remaining <br /> covenants, restrictions and conditions shall not be affected, but shall <br /> remain in full force and effect. <br />
