<br /> 4.9 Hazardous Substances• En�tronmenta� Prv�isions. Trustor repres�n#s and warrants to

<br /> nv#and has not been a si#e for the use, generatian, manufacture, storage, �r�atment, disposal, re�ease ar
<br /> threatened release, transportation or presence of any subs#anc�s wh�ch are"hazardous substances,"
<br /> "hazardous wast�s," "hazardous materials"ar"toxic substancesrr under the Hazardous Ma�erials Laws, as
<br /> defined be�ow, andlor other applicable en�ironmenta� faws, ordinanc�s and regulations �collecf��ely, #he
<br /> "Hazardvus Mat�rials"}.

<br /> Hazardous Materials �collec#i�ely, fhe rrHazardous Materials Laws"}, including wi#haut I�mi�ativn, the Clean
<br /> Air Ac�, the Federal Water Pollution Control Act, the Federal Resource Conservation and Reco�ery Act of
<br /> �976, th� Gomprehensi�e Environmental Resp�nse, Cvmpensation and Liabi��ty Ac#af�98�, #h�
<br /> Superfund Amendments and Reauthorization Act of'198G, the Federal Toxic Substances Cvntr�l Ac�and
<br /> the�ccupational Safety and Health Act, as any of the same may�e amended, mvdified or supplemented
<br /> from time fv time, and any other applicabie federaf, state vr iocal en��ronmental laws, and any rules or
<br /> regula#ivns adopted pursuant to any of the foreg�ing.
<br /> �c} There are no claims or actions pending vr#hreatened against Trustor or the Subject Property
<br /> by any g��ernmental ent�ty or a�ency, ar any other persvn or en�ity, relatEng to any Hazardous Materials
<br /> or pursuant t�any Hazardaus Materials Laws.
<br /> �d} Trus�ar hereby agrees to defend, indemnify and hold harmless Benef�c�ary, i#s directors,
<br /> �fficers, emp�oyees, agents, successors and assigns, frvm and against any and all Iosses, damages,
<br /> liabilities, cfaims, activns,judgments, court casts and i�gal or ather ex�enses �including without limitativn,
<br /> attorn�ys'fees and expenses}which Benefic�ary may incur as a direcf�r indirect consequence of the use,
<br /> generatian, manufacture, stvrage, treatment, dispasai, reiease or threatened release, transportatian or
<br /> presence of Hazardvus Materials in, on, under or abvut th�Subject Property. Trustor shall pay ta
<br /> Beneficiary immediately upan demand any amoun#s owing under this indemnity, together with interest
<br /> frvm the date of demand unt�l paid in fu�l af the highest rate af�nter�st applica�le to any Secured
<br /> �bligafinn. TRUST�R'S DUTY AND�BLI�ATI�N T� DEFEND, INDEMN�FY AND H�LD HARMLES� �
