20000013 ? <br /> 2. Oversi�ht.Annual Inspection,Maintenance and Repair. Subgrantee agrees to <br /> assume the oversight and annual inspection of the Property and improvements situated thereon, : <br /> and Subrecipient agrees to assume and pay the cost of the continued maintenance and repair of <br /> the Property so as to preserve the architectural, historical, or archeological integrity of the same : <br /> in order to protect and enhance those qualities that made the Property eligible for listing in the <br /> National Register of Historic Places, which oversight, inspection, maintenance and repair <br /> requirements are more particularly set forth in the Historic Preservation Easement. <br /> 3. Visual or 5tructural Alterations. Subgrantee and Subrecipient agrees that no visual <br /> or structural alterations to exterior of the Property, as more particularly defined and described in : <br /> the Historic Preservation Easement, will be made without prior written permission of the Grantee : <br /> and Subgrantee. <br /> 4. Grantee Inspection. Subgrantee and Subrecipient agree that Grantee, its agents and : <br /> designees shall have the right to inspect the Property at all reasonable times in order to ascertain <br /> whether or not the conditions of this agreement are being observed. : <br /> 5. Public Viewing. Subgrantee and Subrecipient agree that the Property will be open to <br /> the public for the purpose of viewing work paid for with federal-aid assistance no less than <br /> twenty-four(24) days a year plus at other times by appointment. Nothing in this agreement will <br /> prohibit the Subgrantee or Subrecipient from charging a reasonable, nondiscriminatory <br /> admission fee, comparable to fees charged in similar facilities in the area. <br /> 6. Compliance with Federal Law. Subgrantee and Subrecipient agree to comply with <br /> Title VI of the Civil Rights Act of 1964 (42 U.S.C. 2000 (d)), the Americans with Disabilities : <br /> Act, and with Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 794). These laws <br /> prohibit discrimination on the basis of race, religion, national origin, or disability. <br /> To comply with the Americans with Disabilities Act, and with Section 504 of the <br /> Rehabilitation Act, when interior public access is required at least twenty-four(24) days per year <br /> and at other times by appointment, Subgrantee and Subrecipient are not required to make every <br /> part of the Property accessible to and usable by handicapped persons by means of physical <br /> alterations. That is, for public access periods, videos, slide presentations, and or/other audio- : <br /> visual material and devices may be used to depict otherwise inaccessible areas or features. : <br /> 7. Public Access Notice. Subgrantee and Subrecipient agree that when the interior of : <br /> the Property is not open to the public on a continuing basis, notification will be published in <br /> newspaper of general circulation in the Grand Island, Nebraska area giving dates and times when <br /> the interior of the Property improved with the federal-aid assistance will be open to the public for <br /> viewing. If the Property is open to the public on a continuing basis, Subgrantee and Subrecipient <br /> shall confirm such status in writing annually to the Grantee. If the Property is not open to the <br /> public on a continuing basis throughout any year during the term of this agreement, Subgrantee <br /> and Subrecipient shall provide to Grantee proof of the required published notification by <br /> delivering a copy of the Affadavit of Publication within twenty-one (21) days after the final <br /> publication of such notice. <br /> 8. Value. Subgrantee and Subrecipient agree that this Preservation Covenant gives <br /> Grantee a valuable property right immediately vested in Grantee that is equal to a fixed <br /> Exhibit"B" <br /> Page 2 of 7 : <br />
