EXHIBIT "B" 2 0 0 0 0 013� <br /> PRESERVATION COVENANT <br /> This agreement is made the�_�day of , 1999, by HALL COUNTY, a <br /> Municipal Corporation, (hereafter referred to as the"Subgrantee") and in favor of the STATE <br /> OF NEBRASKA acting through the Nebraska Department of Roads (hereafter referred to as the <br /> "Grantee") and the HALL COUNTY HISTORICAL SOCIETY, a Nebraska Corporation, : <br /> (hereinafter referred to as the"Subrecipient"). <br /> WITNESSETH: <br /> WHEREAS, Subrecipient is the owner in fee simple of certain property known as the : <br /> Historic Grand Island Burlington Railroad Depot, located at 603 North Plum Street, in the City <br /> of Grand Island, State of Nebraska, as more fully described in Exhibit"A" attached hereto and : <br /> incorporated herein by this reference(the"Property"herein); and <br /> WHEREAS, the Property has substantial and important architectural, historical or : <br /> archeological character and is registered on the National Register of Historic Places; and : <br /> WHEREAS, the Property is a historic transportation facility which has been designated <br /> as being eligible for the Enhancement Program portion of the Surface Transportation Program <br /> funds by the Department of Transportation, Federal Highway Administration, administered : <br /> through Grantee and Subgrantee in compliance with Federal laws pertaining thereto; and <br /> WHEREAS, Subgrantee will receive or has received the sum of$227,743 in federal-aid : <br /> assistance through Grantee from the Federal Highway Administration for interior and exterior : <br /> rehabilitation of the Burlington Depot pursuant to Project No. STPB-40(47), State Control Na : <br /> 42111; and <br /> WHEREAS, Subrecipient(as Grantor) has gr ted Subgrantee (as Grantee) a certain <br /> Historic Preservation Easement in the Property, dated��G�..s.,�i4 �G , 1999, which has . <br /> been or will be filed of record against the Property (herinafter referred to as the "Historic <br /> Preservation EasemenY'); and <br /> WHEREAS,the parties desire to supplement the Historic Preservation Easement and to <br /> provide for additional covenants related to Subgrantee's receipt and use of the federal-aid : <br /> assistance. <br /> NOW THEREFORE, in consideration of the premises, and other good and valuable : <br /> consideration, Subgrantee, Subrecipient and Grantee agree as follows: : <br /> 1. Term. This Preservation Covenant shall be deemed a covenant running with the land <br /> for a term of twenty (20)years from and after the date of filing with the Office of the Register of <br /> Deeds, Hall County, Nebraska,but shall terminate upon extinguishment of the Historic : <br /> Preservation Easement pursuant to paragraph 5 thereof. <br /> Exhibit"B" <br /> Page 1 of 7 <br />
