EXHIBIT "B" 2 0 0 0 0 013� PRESERVATION COVENANT This agreement is made the�_�day of , 1999, by HALL COUNTY, a Municipal Corporation, (hereafter referred to as the"Subgrantee") and in favor of the STATE OF NEBRASKA acting through the Nebraska Department of Roads (hereafter referred to as the "Grantee") and the HALL COUNTY HISTORICAL SOCIETY, a Nebraska Corporation, : (hereinafter referred to as the"Subrecipient"). WITNESSETH: WHEREAS, Subrecipient is the owner in fee simple of certain property known as the : Historic Grand Island Burlington Railroad Depot, located at 603 North Plum Street, in the City of Grand Island, State of Nebraska, as more fully described in Exhibit"A" attached hereto and : incorporated herein by this reference(the"Property"herein); and WHEREAS, the Property has substantial and important architectural, historical or : archeological character and is registered on the National Register of Historic Places; and : WHEREAS, the Property is a historic transportation facility which has been designated as being eligible for the Enhancement Program portion of the Surface Transportation Program funds by the Department of Transportation, Federal Highway Administration, administered : through Grantee and Subgrantee in compliance with Federal laws pertaining thereto; and WHEREAS, Subgrantee will receive or has received the sum of$227,743 in federal-aid : assistance through Grantee from the Federal Highway Administration for interior and exterior : rehabilitation of the Burlington Depot pursuant to Project No. STPB-40(47), State Control Na : 42111; and WHEREAS, Subrecipient(as Grantor) has gr ted Subgrantee (as Grantee) a certain Historic Preservation Easement in the Property, dated��G�..s.,�i4 �G , 1999, which has . been or will be filed of record against the Property (herinafter referred to as the "Historic Preservation EasemenY'); and WHEREAS,the parties desire to supplement the Historic Preservation Easement and to provide for additional covenants related to Subgrantee's receipt and use of the federal-aid : assistance. NOW THEREFORE, in consideration of the premises, and other good and valuable : consideration, Subgrantee, Subrecipient and Grantee agree as follows: : 1. Term. This Preservation Covenant shall be deemed a covenant running with the land for a term of twenty (20)years from and after the date of filing with the Office of the Register of Deeds, Hall County, Nebraska,but shall terminate upon extinguishment of the Historic : Preservation Easement pursuant to paragraph 5 thereof.
