Cobb and Anita L. Cobb, husband and wife, (hereinafter sometimes collectively <br />"Borrower ") in favor of U.S. Bank National Association (hereinafter sometimes "U.S. Bank" or <br />"Current Beneficiary "); and Edward E. Brink, a member of the Nebraska State Bar Association, <br />as Successor Trustee (hereinafter sometimes "Successor Trustee "). <br />WHEREAS, on or about December 12, 2006, Stacy L. Cobb and Anita L. Cobb, husband <br />and wife, executed that certain Deed of Trust wherein they are collectively referred to as <br />"Borrower ", in favor of First NLC Financial Services, LLC, d/b /a The Lending Center <br />designated in said Deed of Trust as "Lender" and wherein Mortgage Electronic Registration <br />Systems, Inc., acting solely as nominee for the Lender and Lender's successors and assigns, is <br />identified as `Beneficiary" and Northwest Title and Escrow Corp. is named as Trustee; which <br />Deed of Trust was executed by Borrower to secure the payment of a promissory note signed by <br />the Borrower in favor of Lender, dated December 12, 2006, in the original principal amount of <br />Ninety -Seven Thousand Five Hundred and no /100 Dollars ($97,500.00), plus interest accruing <br />thereon as provided in said promissory note and said debt to be paid in full not later than January <br />01, 2037; which Deed of Trust was recorded on December 27, 2006 as Instrument No. <br />0200611427, in the Mortgage Records of the Office of the Register of Deeds of Hall County, <br />Nebraska, a copy of which Deed of Trust is attached hereto marked as Exhibit "A ", incorporated <br />herein by this reference and forming a part hereof (hereinafter "Deed of Trust "); and <br />WHEREAS, subsequent to the execution of the Deed of Trust, Borrower and Current <br />Beneficiary became aware of a mutual mistake in the legal description contained in the Deed of <br />Trust; and <br />WHEREAS, the Deed of Trust currently encumbers the real property legally described <br />Lot Seven (7), Block Eight (8), Kemohan and Decker's Addition to the City of <br />Grand Island, Hall County, Nebraska (hereinafter sometimes "Lot 7 "); <br />
