hereinafter referred to as "the Retained Property "; and <br />201406877 <br />Lot One (1), Baxter Acres Subdivision, in the City of Grand Island, Hall County, <br />Nebraska, <br />WHEREAS, Tom has joined in the execution of this Agreement for Restrictive <br />Covenants, Easement and Right of First Refusal as to his marital interest as Elizabeth's husband; <br />WHEREAS, as part of the consideration for the sale and purchase of the Purchased <br />Property by Gian from Elizabeth, Gian has agreed to certain restrictive covenants on the use of <br />the Purchased Property by Gian on the terms and conditions contained herein; and <br />WHEREAS, as part of the consideration for the sale and purchase of the Purchased <br />Property by Gian from Elizabeth, Gian has agreed to the use of certain portions of the Purchased <br />Property by Elizabeth on the terms and conditions contained herein; and <br />WHEREAS, as part of the consideration for the sale and purchase of the Purchased <br />Property by Gian from Elizabeth, Gian has agreed to grant to Elizabeth a right of first refusal <br />upon the terms and conditions contained herein; <br />NOW, THEREFORE, in consideration of the conveyance of the Purchased Property from <br />Elizabeth to Gian and other good and valuable consideration, it is agreed: <br />1. Restrictive Covenants. Gian agrees for herself and her heirs, legal <br />representatives, successors and assigns to restrictive covenants on the use of the <br />Purchased Property by Gian and her heirs, legal representatives, successors and assigns <br />on the following terms and conditions: <br />(a) Use for Residential Purposes. Gian agrees that the Purchased Property <br />shall be used exclusively for residential purposes and that no buildings shall be <br />constructed on the Purchased Property except for one (1) single family dwelling and an <br />attached or detached garage without the written consent of Elizabeth (or the current <br />owner of the Retained Property). <br />(b) No Further Subdivision. Gian agrees that the Purchased Property shall not <br />be further subdivided. <br />(c) Right of Enjoyment. Gian agrees that she will not take any action that <br />would impede or interfere with in any manner any intended uses of the Retained Property <br />for agricultural, farming or ranching purposes including, but not limited to, the raising, <br />feeding, growing or breeding of livestock or for other developmental purposes. <br />(d) Benefit. The restrictive covenants herein shall be for the benefit of <br />Elizabeth, and her heirs, legal representatives, successors and assigns and may be <br />enforced by Elizabeth, and her heirs, legal representatives, successors and assigns. <br />2 <br />
