If it has reasonable cause, <br /> Lender may inspect the interior of the impro�ements on the Prflperty. Lender shall give Barrower notice at the�ime <br /> of or prior to such an interiar inspection specifying such reas�nable cause. <br /> 8. �Borrower's Home Equi�y Line of Credit Application Process;Default. Borrower shall be in default <br /> if, during the Accaunt application process,or at any time during the term of the Agreement,Borrflwer or any persons <br /> or entities acting at the direction af Borrflwer or with Eorrower's knowledge or consent ga�e materially false, <br /> misleading, or inaccurate informatian or sta�emen�s to Lender�ar failed to pro�ide Lender with ma�eria�informati�n} <br /> in connection with the Account. Material representations inc�ude, but are n�t 1imi�ed�o, representations concerning <br /> Borrower's occupancy af the Praperty as Eorrawer's principal residence. <br /> Borrower is also in default if: I} Borr�wer engages in fraud or makes a material misrepresentation at any time <br /> in cannection with Borrower's Accaunt; 2} Lender does not recei�e the full amount of any Minimum Payment du� <br /> ar Borrawer faiis to meet any of the ather repayment terms of the Agreement; 3� Borrawer's action or inaction <br /> adversely affects the Property ar Lender's rights in it. Examples af these actions or inactions include, but are not <br /> limited to: a}Borrawer's death, if Borrawer is the sole person nn the Account; or the death nf al1 but one borrower <br /> which adverseiy affects Lender's security; b} Illegal use of the Property,if such use subj ects the Pr�perty to seizure; <br /> c} Transfer af al�or part af the Borrawer's interest in the Praperty withaut Lender's written cansent; d} All or part <br /> af the Praperty is taken by condemnati�n or eminent domain; e} Foreclosure of any senior lien an the Praperty; f} <br /> Failure to maintain required insurance an the Praperty; g} Waste or destructive use af the Property which adversely <br /> affects Lender's security; h} Failure ta pay taxes ar assessments on the Property; i} Permi�ting the creation of a <br /> senior lien on th�Property other than an Appro�ed Prior Loan; �} Filing af a judgment against Borrawer, if the <br /> amaunt of the judgment and col�ateral subject to the judgment is such that Lender's security is ad�ersely affected. <br /> Lender may, at its optian, take Iesser actions than thase described at the beginning of this 5ect�on. Such lesser <br /> actians may include, without limitation, suspending Borrflwer's Accnunt and not allawing Borrower tv obtain any <br /> further Ad�ances, reducing Borrawer's Credit Limit, andlor chang�ng the payment terms an Borrower's Account. <br /> If Lender takes any such actions, this shal�not constitute an election of remedies or a wai�er of Lender's right ta <br /> exercise any rights or remedies under the remainder of this Section, �he remaining pro�isians of the Agreement, the <br /> Security Instrument, ar at�aw or in equity. Lender may take action under this Sectian aniy after camplying with any <br /> n:�tice or cure provisions required under Applicable Law. In the e�ent���nder�lects not to terminate the Account ar <br /> �a�ke any lesser action as pra�ided in this Section, Lender daes nat for�eit or wai�e its right to da sa at a later time i f <br /> any of the circumstances des�ribed abo�e exists at that time. <br /> 9. Pratection af Lender's Interest in the Property and Rights Under this Security InStrument. If�a� <br /> Borrower fails ta perform the co�enants and agreements contained in this Security Instrument, �b}there is a lega� <br /> proceeding that might significantly affect Lender's interest in th�Property andlor rights under this 5ecurity Instrument <br /> (such as a proceeding in bankruptcy, probate, for condemnation or forfeiture, for enfarcement of a lien which may <br /> attain priority over this Security Instrument or to enfarce laws ar regulations}, or�c�Borrower has abandaned the <br /> Property, then Lender may do and pay far whatever is reasonable or appropriate to protect Lender's interest in the <br /> Property and rights under this Security In�trument, including protecting andlor assess�ng the�alue of the Praperty, <br /> and securing andlor repairing the Property. Lender's actians can include, but are not limited to: �a}pay�ng any <br /> S�cured Debt secured by a lien which has priority over this Security Instrument;�b�appearing in caurt;and�c}paying <br /> reasonable attarneys' fees ta pratect its interes�in the Praperty andlor rights under this S�curity Instrument,including <br /> its secured pasitian in a bankruptcy proc�eding. Lender may withaut notice, perform or cause ta be performed any <br /> co�enant of Barrower in this 5ecurity Instrument,and Borrower appoints Lender as attorney in fact ta sign Barrower's <br /> name. Securing.the Praperty includes, but is not limited t�, entering the Praperty ta make repairs, change Iacks, <br /> replace or baard up doors and windnws, drain water fr�m pip�s, eliminate building or other cade �iolations or <br /> dangerous conditions, and ha�e utilities turned on ar off. Although Lender may take this action,Lender does not hav� <br /> to do so and is nat under any duty or obligation ta do so. It is agre�d that Lender incurs na liability for not taking <br /> any or aIl actions authorized under this Section. <br /> Any amaunts disbursed by Lender under this 5ection shall become additianal Secured Debt of Borrawer secured <br /> by this Security Instrument, payable accarding to the terms of the Agreement and this Security Instrument.
