<br /> and prosecute in iTs own name in the action or proceedings , or to make any compromise or
<br /> settlement in connection with such taking or damage . AII such compensation , awards ,
<br /> damages , rights ot action and proceeds are hereby assigned to Nb rtgagee , who may , after �
<br /> deducfing ther� rom ail of its expenses , including attorney ' s fees , release any money so
<br /> received by it or apply the same on any indebtedness secured hereby . Nbrtgagor agrees to
<br /> execute such further assignments of any compensation , awards , damages and rights of action
<br /> and proceeds as Mortgagee may require .
<br /> 10 . That Mortgagor shali comply , at all times , with all federal and state laws , all
<br /> municfpal ordinances and all rules and regulations of any governmental entity having
<br /> 't jurfsdiction over the premises , insofar as said laws , ordinances , rules and regulations
<br /> pertain in any way to the premises and their use . ,
<br /> . � II . That the Mortgagee , and any persons authorized by Nbrtgagee , shall have the right
<br /> to enter and inspect the premises at all reasonable times .
<br /> � 12 . Mortgagor wiil not further mortgage or encumber the premises , or assign , or
<br /> attempt to assign , the rents , or any part thereof , from said premises . Mortgagor will
<br /> not , except where the lessee is in defauit thereunder , terminate or consent to the cancel -
<br /> lation or surrender of any lease of the premises , or any part thereof , now existing or
<br /> hereatter made , or modify any such lease so as to shorten the unexpired term thereof or
<br /> so as to decrease the amount of rents payable ihereunder, or accept payments of any
<br /> instaliments of rent to become due under such leases tor a period of more than one month
<br /> j in advance . Mortgagor will �ot execute any lease of any portion of the premises except

<br /> : for actual occupancy by the lessee thereunder , will at ali times promptly and faithfully
<br /> ° perform , or cause to be performed , all of the cove� ants , conditions and agreements
<br /> contained in all leases of the premises now or hereafter existing , on the part of the
<br /> lessor thereunder to be kept and performed ; all leases upon the mortgaged premises shall
<br /> � be in form and substance safiisfactory to Mortgagee and , at the option ot Mortgagee , shall
<br /> be assigned to Mortgagee . -
<br /> I3 . In the event that Mortgagor makes an assignment for the benefit of creditors , a
<br /> receiver is appointed for the Mortgagor or for all or any part ot the premises , or if
<br /> Mortgagor tiles a petition or institutes p roceedings in bankruptcy or is adjudicated a "`
<br /> oankr�pt under any state law tor the reliefi of debtors or under the bankruptcy laws �%`
<br /> ; of the United States , or if any of the foregoing shail happen to any co-maker or guarantor
<br /> of the promissory note secured hereby , then , or at any time thereafter , the whole of fihe = ':
<br /> atoresaid indebtedness and all other sums secured by this mortgage and a� y other securing '�;;
<br /> agreement given in connection with this loan shall become due and payable at once at the $":
<br /> option of the Mortgagee and Mortgagee shall be entitled to declare this mortgage to be in ;=?'�
<br /> default . The acceptance of one or more payments on ihe indebtedness or any sums secured
<br /> by this mortgage made by anyone other than the Mortgagor prior to contirmation of fore -
<br /> closure sale shali not constitute Nb rtgagee ' s waiver of its right to accelerate the
<br /> maturity of the aforesaid indebtedness and all other sums secured hereby .
<br /> 14 . No remedy conferred upon or reserved to Mortgagee in this mortgage or a�y other
<br /> securing agreement is intended to be exc � usive of any other remedy or remedies ( and each
<br /> and every such remedy shall be cumulative , and shali be in addition to every other remedy
<br /> given hereunder , or now or hereafter ) existing , at law , in equity or by statute . No delay
<br /> or omission ofi Mortgagee to exercise any right or power accruing upon any default shall
<br /> impair any such right or power , or shail be construed to be a waiver of any such default ,
<br /> or an acquiescence therein ; and every power and remedy given by this mortgage to the
<br /> P4ortgagee may be exercised from time to time as often as may be deemed expedient to
<br /> Mortgagee .
<br /> 15 . Mortgagor will keep adequate records and books of account in accordance with
<br /> generally accepted accounting principles and will deliver to Nbrtgagee , within 45 days
<br /> ' after the close of each of Mo � tgagor ' s fiscal years an itemize� statement certified by
<br /> an offiicer of Mortgagor showing all items ot income and expense for the mortgaged property ,
<br /> setting forth in each case , in comparative form , figures for the preceding year . Through -
<br /> out the term ofi this mortgage , Mortgagor , with reasonable promptness , wiil deliver to
<br /> Mortgagee such other intormation with respect to the mortgaged premises as Mortgagee may
<br /> reasonably request firom time to time . Ail financial statements shall be prepared in
<br /> accordance with generally accepted accounting practice and shall be delivered in duplicate .
<br /> Now if said Mortgagor shall pay or cause to be paid said sums of money when due as
<br /> • set torth in said Note and in this instrument , and any additional advances made , with
<br /> interest , as herein provided , and shall also have paid ali other indebtedness secured by
<br /> this Niortgage and sha � l have faithfully and fuliy kept and performed each and all of the
