No public water service is available to the subdivision . <br /> r ° • Accordingly , private wells are authorized within said subdivision to <br /> { � <br /> serve the respective lots therein . The Subdividers further agree to waive <br /> all objections to the creation of a water district , and to connect any <br /> and all structures existing prior to the construction of said district <br /> within three years after public water service becomes available , and that <br /> a11 structures constructed after the availability of public water service <br /> shall connect to said service . <br /> 3 . Sanitary Sewer . Sanitary sewer service is available in Bass <br /> Road for said subdivision . The Subdividers hereby agree to connect with <br /> said sanitary sewer service within Bass Road upon seeking approval of and <br /> cooperation with the installers of said sanitary sewer , Rex J . H . Otto <br /> and James H . St� eeks , Jr . , the developers of Rainbow Lalce Subdivision ; and <br /> to pay any and all charges which would be reasonably assessed against said <br /> subdivision . The Subdividers further agree that upon payment of appropriate '! <br /> charges that any and all structures constructed within said subdivision �' <br /> � <br /> ' shall connect to the sanitary sewer service . ' " ' <br /> 4 . Drainage . The Subdividers agree to grade the lots of the sub - ` � , :' <br /> .a`� <br /> division in conjunction with the construction of any structure thereon so <br /> ' ` that storm water drains to public right - of -way or to the adjacent lake . � � <br /> 5 . Sidewalks . The City hereby waives the immediate construction of <br /> any and a11 sidewalks adjacent to said subdivision and within said sub - <br /> division . However , the Subdividers agree that any and all sidewalks will <br /> be constructed by the lot owner within six months after a directive from <br /> the Grand Island City Council . <br /> 6 . Warranty . The undersigned owners , as Subdividers , warrant that : <br /> they are the owners in fee simple of the land described and proposed to <br /> be known as Lake Heritage Subdivision , and that an abstract of title will <br /> be submitted for examination , if necessary , upon request of the City of <br /> Grand Island . <br /> v 7 . This agreement shall run with the land and shall be binding upon <br /> and inure to the benefit of the parties hereto , their successors , assigns , <br /> heirs , devisees , and legatees .
