Water and Sanitary Sewer . Since public wate; an.d sanitary <br /> " sewer service are not available to the proposed subdivision , individual <br /> water wells and septic tanks to serve the individual lots in the proposed <br /> subdivision are hereby allowed and shall be provided . The Subdividers , <br /> their successors , assigns , heirs , devisees and legatees , further agree <br /> that no objection shall be fiLed in relation to the creation of a sanitary <br /> sewer or water district , and that upon completion o £ sanitary sewer <br /> service or water service , all structures located within said subdivision <br /> shall connect to such service mains with three construction seasons of <br /> such completion . <br /> 3 _ Draina�e _ Before building permits will be issued for any lots <br /> in the proposed subdivision , the Subdividers shall grade the lots in con - <br /> junction with the structures thereon according to plans approved by the <br /> Hall County Director of Public Works . The Subdividers covenant and agree <br /> not to challenge , protest , or object to the formation or creation of a <br /> drainage improvement district by the proper governmental authority as <br /> authorized by Chapter 31 , Revised Statutes of Nebraska , as amended . This <br /> covenant shall not be construed to prevent a landowner from challenging , <br /> protesting , or objecting to the amount of any particular tax or assess - <br /> ment on his particular lot or tract of land . <br /> 4 . Easements . The Subdividers covenant and agree not to change <br /> the grades of the easements in the proposed subdivision without prior <br /> approval of public utilities or utilities companies that have utilities <br /> located in said easement . The grades in such easements shall not be <br /> changed or obstructed without approval of public utilities or utilities <br /> companies so as to make such easements obstructed or unsafe for utilities <br /> purposes . <br /> 5 . Warranty .
