Johnson, hereinafter <br /> referred to as owners, are the deveLopers and owners o£ all lots <br /> in Meadowlark Estates Subdivision, hereinafter referred to as the <br /> subdivision, located in the Southwest Quarter (SWi) c�f the North- <br /> east Quarter (NCi) of Section T'hirty-Two ( 32) , Township Eleven <br /> (22) North, Range Nine (4) , West of the 6th P. M. , Ha21 County, <br /> Nebraska; and <br /> WHEREAS, it is the desire of the owners to improve the sub- <br /> division by encouraQin� the sale �f lots and construction of <br /> modern and desirable dwellin� houses; <br /> NOW, THEREFORE, in consideration there�f, and of the mutual <br /> benefits to be derived by the owners of said subdivision, and any <br /> purchaser or purchasers of lc>ts therein, their heirs, successors, <br /> personal representatives and assiqns, the c�wners hereby stipulate <br /> and aRree that any and all lots in said subdivision sold, given, <br /> devised, transferred and conveyed shall be and the same are sub- <br /> ject to the followinR restrictive covenants, all of which shall <br /> run with the land as foilows: <br /> 1. All lots in the subdivision shall be zoned and used as <br /> residential lots. No structure shall be erected, altered, placed <br /> or permitted to remain on any lot other than one detached modern <br /> sinQle family dwellinq not to exceed two stories in height with <br /> not less than a two car attached �araQe. Only one ad�3itional <br /> accessory builciin� shall be �ermitted �n a 1ot and such building <br /> shall have the same exterior desiRn, roof and finish as the dwel- <br /> ling house. Lots may not be split or divided to create additional <br /> lots. Only cnP family may occupy a dwel.lin�. No multi-family <br /> dwellin�s shall be allowed. <br /> 2. 1'he owner of each lot shall keep his h<�use, Rarage, and <br /> any accessory buildinK in �ood repair and appearance. The owner <br /> of each lot shall also properly maintain his yard, fences, lawn, <br /> shore line, bushes, trees and all �ther portions of his lot in <br /> such a manner as will be aesthetically attractive and n�t deKrarle <br /> the appearance �f `he subdivisic�n. <br /> 3. For purposes of front yard and side yard set back re- <br /> quirements, the zonin,� and buildinR regulations of the City of <br /> Grand Island, Nebraska shall apply. F�r purpose of deterrnininQ <br /> the front Lot line, it shall be conclusively presumed that the <br /> front of the Lot is the side which faces away from the lake. The <br /> back of the lot shall be presume� to front upon the lake. <br /> 4. A one story dwellin� shall have not less than 1900 <br /> square feet of �round floor area. A st�ry and a half or two <br /> story dwellin� shall have not less than 1200 square feet of qround <br /> floor area. No split level c�r basement hc�uses shall be permitted. <br /> In determinint� the amount of square foc,taQe, all �pen nc�rches and <br /> attached garages shall be excluded from such camputatic�n. All <br /> dwellin�s sha11 have an exterior appearance and elevation in keep- <br /> ing with the native and natural surrounclin�s. <br /> 5. No outside television or radio antennas shall be permitted <br /> in the subdivision. No radio transmittin� or receivinR tower nr <br /> pole shall be located in the subdivision.
