[ahen a sewer line is laid in any street on which the tract abuts , <br /> � it shall be incumbent and obligatory upon the owner of the tract to <br /> establish connection with the sewer system without delay and thereafter <br /> to rnake use of the sewer system to the exclusion of al. l septic tanks and <br /> other private methods of handling sewerage . <br /> 12 . CesspooZs shall not be permitted on the tract . A septic tank and <br /> disposal field may be constructed on the tract , provided the septic tank <br /> and disposal field are �constructed in accordance with the plans and <br /> specifications approved by the Department of Health of the State of <br /> Nebraska , <br /> 13 . A11 construction and building upon the tract shall be so performed <br /> that it will comply with the requirements of the building codes and <br /> ordinances , including building code ordinances , electrical code ordinances , <br /> and plumbing code ordinances , of the City of Grand Island , Nebraska . <br /> 14 . No £ences or hedges for the purpose of dividing or enclosing <br /> properties shall be constructed or planted forward of the front elevation <br /> of any residential house or residential main structure . <br /> 15 . If any of these restrictions and covenants running with the land <br /> ( tract described in the Deed to which these Restricti. ons and Covenants <br /> Running With the Land are attached ) are violated and declared void by a <br /> court of competent jurisdiction , the remaining restrictions and covenants <br /> running with the land shall not be affected but shall stay and remain in <br /> full force and effect . <br /> 16 . The tract cannot be subdivided into lesser tracts of less width than <br /> one hundred forty and twenty - five hundredths ( 140 . 25y feet nor a depth of <br /> less than three hundred thirty ( 330 . 0 ) feet . If this tract is subdivided , <br /> the dividing line of the subdivided tract , for the purpose of Paragraph 4 <br /> of these Restrictions and Covenants Running With the Land , shall be <br /> ; considered as a tract line or lot line and no building can be constructed <br /> closer than twenty ( 20 ) feet to the tract line or lot line . <br /> �` 17 . If any owner of the tract or subdivided tracts or his , her or their <br /> ; � � � � <br /> heirs , or assigns , shall violate or attempt to violate any of these <br /> restrictions and covenants , it shall be lawful for any other person or , <br /> persons owning any real estate in the tract to prosecute proceedings at <br /> law or in equity against the person or persons violating or attempting to <br /> violate ariy restriction or condition and to prevent him , her or them , or <br /> assigns , from violating any of the restrictions or conditions and to <br /> recover daznages for the violations . <br /> 18 .
