201404665 <br />the common elements. All such repairs and maintenance shall be common expenses and shall be paid for by the <br />Association. <br />5.1 Duties of Owners. Each owner of a unit shall maintain, repair, replace and restore, at his own <br />expense, all portions of his unit, subject to the Declaration and rules and regulations of the Association. Each <br />owner shall, at his own expense, maintain, repair, replace and restore all doors, window glass, and any heating, <br />cooling and air conditioning systems and equipment exclusively serving his unit, and all electrical and plumbing <br />fixtures and appliances exclusively serving his unit, including, without limitation, laundry equipment, water <br />heaters and other built -in appliances. Each owner shall clean, maintain, repair, replace and restore all interior <br />finishes, including, without limitation, floor coverings and wall coverings. No owner shall remove, alter, injure <br />or interfere in any way with any shrubs, trees, grass or plantings placed upon the condominium by the Declarant <br />or the Association without first having obtained the written consent of the Association. In addition, each owner <br />shall be responsible for the maintenance and repair of the limited common elements (except for the structural <br />parts of the limited common elements) to which he has the right of exclusive use pursuant to Section 2.6 of this <br />Declaration. Each owner shall take all necessary action to keep the limited common elements free and clean <br />from unsightly accumulations of weeds, trash and litter. Each owner shall have an easement over, across and <br />through such portions of common elements as are necessary in order for the owner to perform his obligations <br />under this Section with respect to the maintenance, repair, replacement and restoration of those portions of the <br />common elements and limited common elements which he is obligated to maintain. <br />5.2 Repair or Restoration Necessitated by Owner. Each owner shall be liable to the Association to the <br />extent provided for by Nebraska law, for any damage to the common elements or the improvements, <br />landscaping or equipment thereon which results from the negligence or willful conduct of the owner or the <br />owner's family, employees, guests and invitees. The cost to the Association of any such repair, maintenance or <br />replacements required by such act of an owner or the members of his family, guests or invitees, shall be paid for <br />by said owner, upon demand, to the Association. The Association may enforce collection of such amounts in <br />the same manner and to the same extent as provided for in this Declaration for the collection of assessments. <br />5.3 Association's Right of Access. Each owner hereby grants to the Association a right of access to the <br />common elements for the purpose of enabling the Association to exercise and discharge its powers, duties and <br />responsibilities under this Declaration. This right of access shall include, without limitation, the right to enter <br />upon the common elements for the purpose of determining whether the provisions of this Declaration are being <br />complied with by the unit owners, family members, guests and invitees, tenants and licensees. The Association <br />shall have the right to enter a unit in case of emergency. <br />ARTICLE VI. <br />THE ASSOCIATION <br />6.0 Rights, Powers, and Duties of the Association. The Association shall be an unincorporated <br />association, and shall have such rights, powers and duties as are prescribed by the Condominium Act and as are <br />set forth in this Declaration, together with such further rights, powers and duties as may be reasonably <br />necessary to effectuate the objectives and purposes of the Association as set forth herein. <br />6.1 Directors and Officers. The affairs of the Association shall be conducted by an Executive Board <br />and such officers and committees as the Directors may elect and appoint, in accordance with this Declaration <br />and the By -Laws. <br />6.2 Association Rules. By a majority vote of the Executive Board, the Association may, from time to <br />time and subject to the provisions of this Declaration, adopt, amend and repeal rules and regulations.
