201401 721 <br /> Each party shall keep the personal property in each party's possession. In particular, the <br /> following property and debts shall be divided as follows. <br /> a. Defendant is awarded the house at 207 N. Waldo, Grand Island, NE <br /> b. Plaintiff shall pay any debt with respect to 207 N. Waldo, Grand Island, NE <br /> c. Plaintiff is awarded a 2009 Dodge pickup,2005 Chrysler 300, Pontiac Grand <br /> Prix 3000 and a 1998 camper. To the extent that there is debt against any of these vehicles <br /> Plaintiff is solely responsible to pay said debt. <br /> d. Defendant is awarded the 1993 Lumina <br /> e. Plaintiff will pay his own hospital bills <br /> f. Each party will pay their own debts incurred since their separation. <br /> 8. The Court finds that Plaintiff is a longtime railroad employee entitled to railroad <br /> retirement benefits pursuant to the federal Railroad Retirement Act. Plaintiff's railroad <br /> retirement benefits were earned during the course of the parties' marriage and therefore <br /> constitute marital property subject to equitable division under Nebraska State law. The Court <br /> recognizes that Plaintiff's railroad retirement benefits and any entitlement to those benefits held <br /> by Defendant are subject to federal law. It is the intent of this Court to award to each party an <br /> equal share of divisible benefits proportionate to the period of the marriage as follows: <br /> Defendant,Nancy Nichols,is awarded, and the Railroad Retirement Board is directed to <br /> pay, an interest in the portion of Plaintiff's, Frank Nichols' benefits under the Railroad <br /> Retirement Act(45 U.S.0 §231) which may be divided as provided by section 14 of that Act(45 <br /> U.S.C. §231m). Nancy Nichols' share shall be computed by multiplying the divisible portion of <br /> Frank Nichols' monthly benefit by a fraction, the numerator of which is the number of months <br /> Frank Nichols worked for a railroad employer during the period of the marriage(which was <br /> from July 3, 1969 until the date of this decree as set forth below), and the denominator of which <br /> shall be Frank Nichols' total number of months employed by a railroad employer at retirement, <br /> and then dividing the product by two. <br /> 9.
