Take possession of the Mortga��d Praperty, br�ng any action necessary to �nfarc� <br /> any rights af Borr�wer gr�wing out of the M�rtgaged Property's op�rat�on, and maintain <br /> the Mortgaged Pr�p�rty in deGent, safe, and sanitary condition and good repair; <br /> v. Apply to any caurt, state or federal, f�r specific performance of th�s Agre�ment, far <br /> an injunction against any Violat�ons of this Agr��ment, far th� appointment of a recei�er <br /> t� take over and �perate the Project in accordance with this t�rms of the Agr��ment, or <br /> for such �ther relief as may be appropriate, as the injury t� HUD arising from a defau�t <br /> und�r any af the terms of this Agreement would b� irreparable and the amount of <br /> damage would b� difficult to ascerkain; and, <br /> ��. IVIEASURE �F DAI�A�ES. The damage t� HUD as a result af Borrovver's breach <br /> of duti�s and �bligations under this Agreement sha11 be, in the case of failure to <br /> maintain th� Mortgag�d Property as r�quired by this Agre�m�nt, the cast �f the repairs <br /> required to return the Project t� d�cent, safe and sanitary condition and go�d repair. <br /> Th�s cvntractua� provision shall not abr�ga�e �r limit any �ther rem�dy �r m�asur� af <br /> damages avaElable to HUD under any civ'ri, cr�m�nal ar common law. <br /> VIII.
