Box 790 <br />Grand Island, NE 68802 -0790 <br />Easement <br />1 <br />EASEMENT <br />ON <br />es <br />N <br />CO <br />This Easement is made and entered into this ca/0 of February, 2014 by and between <br />WALNUT STREET PARTNERSHIP, a Nebraska general partnership, hereinafter referred to as <br />"Grantor ", and WHEELER STREET PARTNERSHIP, a Nebraska general partnership, <br />hereinafter referred to as "Grantee ". <br />WITNESSETH: <br />WHEREAS, Grantor is the owner in fee simple of that real estate generally described as <br />( "Tract 1"): <br />A tract of land comprising a part of Lot Six (6), Block Eighty One (81), Original <br />Town in the City of Grand Island, Hall County, Nebraska, more particularly <br />described as follows: <br />Beginning at the southeast corner of said Lot Six (6); thence running westerly on <br />the southerly line of said Lot Six (6), a distance of Twenty Six (26.0) feet; thence <br />running northerly parallel with the easterly line of said Lot Six (6), a distance of <br />Sixty Three (63.0) feet; thence running easterly parallel with the southerly line of <br />said Lot Six (6), a distance of Twenty Six (26.0) feet, to a point on the easterly <br />line of said Lot Six (6); thence running southerly on the easterly line of said Lot <br />Six (6); a distance of Sixty Three (63.0) feet, to the point of beginning and <br />containing 1638 Sq. Ft. more or less (see survey attached); and <br />WHEREAS, Grantee is to be the owner of that real estate described as ( "Tract 2 "): <br />Lots Seven (7) and Eight (8), Block Eighty One (81), Original Town in the City <br />of Grand Island, Hall County, Nebraska; and <br />WHEREAS, pursuant to the terms and conditions provided hereinbelow, Grantor desires <br />to grant a perpetual, non - exclusive easement to the Grantee, (and Grantee's lessees, licensees, <br />customers, invitees, employees, and agents) as the owner of Tract 2 and to all parties <br />subsequently claiming ownership of Tract 2 through Grantee (and its successors and assigns) to <br />use Tract 1 for parking and for ingress and egress over, through and upon Tract 1. <br />NOW, THEREFORE, in consideration of the mutual covenants herein contained, it is <br />1. Recitals. The recitals set forth above are incorporated herein by this reference. <br />2. Conveyance of Easement.
