This Security Instrument, to the extent that it conveys or otherwise deals with property or <br />with items of property which are or which may become fixtures related to the Premises, under <br />Section 1309.502(C) of the Ohio Revised Code, constitutes a financing statement filed and <br />indexed as a fixture filing in the real estate records of the recorder of the county in which such <br />property is located with respect to any and all fixtures and with respect to any personal property <br />that may now be or hereafter become such fixtures. For purposes of the foregoing, Borrower is <br />the debtor (with its address as set forth in this Security Instrument) and Lender is the secured <br />party (with its address as set forth in this Security Instrument). Borrower is the record owner of <br />the Premises. NOTICE. A POWER OF SALE HAS BEEN GRANTED IN THIS <br />SECURITY INSTRUMENT. A POWER OF SALE MAY ALLOW THE LENDER TO <br />TAKE THE MORTGAGED PROPERTY AND SELL IT WITHOUT GOING TO <br />COURT IN A FORECLOSURE ACTION UPON DEFAULT BY THE BORROWER <br />UNDER THIS SECURITY INSTRUMENT. <br />2. The following subsections are added to paragraph 25 of this Security Instrument: <br />(g) If an Event of Default shall have occurred and be continuing, Lender shall have <br />the following rights and remedies, which shall be in addition to and not in limitation of any other <br />rights and remedies set forth in this Security Instrument: <br />(i) Power of Sale. Borrower further grants to Lender, its successors and assign, the <br />right and power to foreclose this Security Instrument under the Oklahoma Power of Sale <br />Mortgage Foreclosure Act, 46 O.S. §40 et seq. (the "Act "). If an action is filed to foreclose this <br />Security Instrument, or it Lender seeks to foreclose this Security Instrument by power of sale <br />under the Oklahoma Power of Sale Mortgage Foreclosure Act, Lender shall be entitled to the <br />immediate appointment of a receiver pursuant to 12 O.S. §1551(2)(c) without the necessity of <br />further proof. If Borrower is then occupying the Mortgaged Property or any part thereof, such <br />receiver shall be entitled to collect rent from Borrower equal to the fair market rent for the <br />portion of the Mortgaged Property occupied by Borrower. <br />(ii) Provisions with Respect to the Power of Sale.
