The first introductory paragraph on Page 1 of this Security Instrument is hereby <br />amended in its entirety to read as follows: <br />THIS DEED OF TRUST, SECURITY AGREEMENT, ASSIGNMENT OF LEASES AND <br />RENTS AND FIXTURE FILING (this "Security Instrument ") as described on Schedule A <br />attached hereto and made a part hereof, dated as of the Effective Date set forth on Schedule A <br />attached hereto and made a part hereof (the "Effective Date "), is made by the Borrower set forth <br />on Schedule A attached hereto and made a part hereof (together with its permitted assigns <br />hereunder, "Borrower "), having its principal office as set forth on Schedule A attached hereto <br />and made a part hereof, to Chicago Title Insurance Company, a Nebraska corporation, as trustee <br />( "Trustee "), having his principal place of business at 106 W. 11 Street, Suite 1800, Kansas <br />City, Missouri 64105, for the benefit of WELLS FARGO BANK NORTHWEST, NATIONAL <br />ASSOCIATION, as lender ( "Lender ") pursuant to the Declaration of Trust dated as of October <br />10, 2013 (the "Declaration "), having its principal place of business at 260 North Charles <br />Lindbergh Drive, MAC: U1240 -026, Salt Lake City, Utah 84116. <br />2. The second paragraph on Page 1 of this Security Instrument is hereby amended in <br />its entirety to read as follows: <br />To secure the payment of an indebtedness in the principal sum of the Loan Amount <br />set forth on Schedule A attached hereto and made a part hereof, in lawful money of <br />the United States of America, to be paid with interest according to the terms of that <br />certain Promissory Note dated as of even date herewith, with a maturity date of <br />January 10, 2036, made by Borrower to Lender (such note together with all <br />extensions, renewals or modifications thereof being hereinafter collectively called the <br />"Note ") and all other Debt (hereinafter defined), Borrower transfers, conveys and <br />assigns to Trustee, IN TRUST, WITH POWER OF SALE, the Premises (as defined <br />herein) which is described in Exhibit A attached hereto and the buildings, structures, <br />fixtures (except "trade fixtures" as defined in Part II Section 19 of the Lease <br />(hereinafter defined) not owned by Borrower), additions, enlargements, extensions, <br />modifications, repairs, replacements and improvements now or hereafter located <br />thereon (the "Improvements "); <br />3. Inconsistent Provisions. In the event that any provision in this Security <br />Instrument shall be inconsistent with any applicable provision of the law of the State of Nebraska <br />governing foreclosure or power of sale under a deed of trust (herein collectively called the <br />"Laws "), the provisions of the Laws shall take precedence over the provisions of this Security <br />Interest, but shall not invalidate or render unenforceable any other provision of this Security <br />Instrument that can be construed in a manner consistent with the Laws. <br />4. Rights and Remedies upon Default. Except as hereinafter provided, if any <br />provision of this Security Instrument shall grant to Trustee or Lender any rights or remedies <br />upon default of Borrower which are more limited than the rights that would otherwise be vested <br />in Trustee or Lender under the Laws in the absence of such provision, Trustee or Lender, as the <br />case may be, shall be vested with the rights granted in the Laws to the full extent permitted <br />
