pledge, assign, hypothecate and warrant the Premises (as defined herein) which is <br />described in Exhibit A attached hereto and the buildings, structures, fixtures (except <br />"trade fixtures" as defined in Part II Section 19 of the Lease (hereinafter defined) not <br />owned by Borrower), additions, enlargements, extensions, modifications, repairs, <br />replacements and improvements now or hereafter located thereon (the "Improvements "); <br />2. The Introductory Paragraph ending on Page 4 of this Security Instrument is hereby <br />amended by adding the following: <br />(t) In addition to the indebtedness evidenced by the Note and all other Debt, this <br />Mortgage, to the fullest extent permitted by the law of the State of Kansas, shall secure <br />also and constitute a lien on the Mortgaged Property for all future advances made by <br />Lender to Borrower and future obligations incurred by Borrower to Lender in connection <br />with the Mortgaged Property to the same extent as if such future advances were made or <br />such future obligations incurred on the date of recording of this Mortgage. The Loan is a <br />revolving credit loan, and principal amounts which Borrower borrows and repays on <br />account of the Loan may be re- borrowed, subject to the terms and conditions of the Loan <br />Documents; all such re- borrowings by Borrower shall be deemed future advances <br />hereunder, and shall be a part of the Obligations and shall be secured hereby. THE <br />TOTAL PRINCIPAL AMOUNT OF THE INDEBTEDNESS THAT SHALL BE <br />SECURED BY THIS MORTGAGE AT ANY ONE TIME SHALL NOT EXCEED <br />A MAXIMUM PRINCIPAL AMOUNT EQUAL TO $10,000,000.00. <br />******************* * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** <br />FOR MORTGAGED PROPERTY LOCATED IN KENTUCKY <br />1. REVOLVING LOAN. The parties hereto intend that this Security Instrument <br />secure a line of credit within the meaning of KRS 382.385. The maximum principal amount of <br />credit which may be extended under the line of credit and which may be outstanding at any time <br />or times under the line of credit, and which is secured by this Security Instrument, is a sum equal <br />to the Loan Amount set forth on Schedule A attached hereto and made a part hereof. <br />******************* * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** <br />FOR MORTGAGED PROPERTY LOCATED IN LOUISIANA <br />1. The Mortgaged Property includes both real and personal property and all other <br />rights and interests, whether tangible or intangible in nature, of Borrower in the <br />Mortgaged Property. This Security Instrument has been executed by Borrower pursuant <br />to Article 3298 of the Louisiana Civil Code for the purpose of securing all Debt that may <br />now be existing and/or that may arise in the future as provided herein, with the <br />preferences and priorities provided under applicable Louisiana law.
