SCHAFER and JOYCE A. SCHAFER, husband and wife, hereafter Schafer, and DOUBLE H PARTNERSHIP, hereafter Happold. WHEREAS, Schafer is the owner of the following tract, hereafter Tract One: A tract of land comprising a part of the Northwest Quarter (NW's) of Section Nine (9) , Township Nine (9) North, Range Nine (9) West of the 6th P.M. , in Hall County, Nebraska, more particularly described as follows: First, to ascertain the point of beginning, start at the Northeast corner of said Northwest Quarter (NW's) , thence running West along the North Line of said Northwest Quarter a distance of Four Hundred and Eight Hundredths (400. 08) feet; thence deflecting left 90°00 ' and running southerly a distance of Forty-eight and Sixty-seven Hundredths (48 . 67) feet to a point on the County Highway South right-of-way line, and being the actual point of beginning; thence continuing southerly along the last described course, a distance .of Five Hundred Twenty-six and Thirty-three Hundredths (526. 33) feet; thence deflecting right 90°00 ' and running westerly a distance of Four Hundred Twenty-five (425. 0) feet; thence deflecting right 90°00 ' and running northerly a distance of Five Hundred Twenty-six and Forty-six Hundredths (526. 46) feet to a point on said Highway right-of-way line; said point being Forty-eight and Fifty-four Hundredths (48 . 54) feet south of the North line of said Northwest Quarter; thence running easterly along said Highway right-of-way line a distance of Four Hundred Twenty-five (425. 0) feet to the actual point of beginning; and WHEREAS, Happold is the owner of the following tract, hereafter Tract Two: The Northwest Quarter (NW's) of Section Nine (9) , Township Nine (9) North, Range Nine (9) West of the 6th P.M. , in Hall County, Nebraska, excepting Tract One. NOW, THEREFORE, in exchange for One Dollar ($1. 00) and other valuable consideration paid by Happold to Schafer, it is agreed by and between the parties as follows: 1. Schafer grants to Happold an easement permitting Happold to operate a pivot, end gun and corner system in such a manner as to pass on and over the southern and western portion of Tract One for the purpose of operating, parking and maintaining a pivot, end gun and corner system so that Happold can operate the system along the same path as it currently travels, and an easement to sprinkle water on the southern and western portion of ■
