<br />KNOW ALL MEN BY THESE PRESENTS: That Ronald S. Depue, a
<br />member of the Nebraska State Bar Association and Trustee, upon a
<br />Deed of Trust made and entered into on or about June 19, 2002, by
<br />and between Baltazar Palma - Ambriz and Gloria Palma- Ambriz, husband
<br />and wife, Trustor, and Bank of Clarks, Beneficiary, and Ronald S.
<br />Depue, Successor Trustee, which Deed of Trust was filed on June 27,
<br />2002, in the Register of Deeds office of Hall County, Nebraska, as
<br />Instrument No. 200206830, herein called the Grantor, in
<br />of Seventy -six Thousand Dollars ($76,000.00), received from
<br />Grantee, does hereby grant, bargain, sell, convey and confirm unto
<br />Bank of Clarks, herein called the Grantee, the following described
<br />real property in Hall County, Nebraska:
<br />Lot 2, Paustian 2nd Subdivision in the City of Grand
<br />Island, Hall County, Nebraska.
<br />TO HAVE AND TO HOLD the above described premises together with
<br />all tenements, hereditaments, and appurtenances thereto belonging
<br />and to the Grantee.
<br />Grantor does hereby covenant with Grantee as follows:
<br />1. That Baltazar Palma- Ambriz and Gloria Palma- Ambriz,
<br />husband and wife, Trustor, failed to pay the Beneficiary payments
<br />which were contractually due and the Grantor, at the request of the
<br />Beneficiary, elected to declare the entire unpaid principal balance
<br />together with interest thereon at once immediately due and payable;
<br />2. That a notice of default was filed by Grantor on June 10,
<br />2013, in the Register of Deeds office of Hall County, Nebraska, as
<br />Instrument No. 201304584. A copy of the notice of default was
<br />mailed to Baltazar Palma - Ambriz and Gloria Palma - Ambriz and to all
<br />parties entitled to notice by certified mail, postage prepaid on
<br />June 13, 2013, and by regular, first -class mail on July 23, 2013;
<br />3. The Trustor, Baltazar Palma- Ambriz and Gloria Palma -
<br />Ambriz, failed to cure the default referenced in the notice of
<br />default within thirty days after the service of the notice of
<br />default;
<br />4. Grantor published notice of Trustee's sale to be held on
<br />October 18, 2013, at 10:00 a.m. at the First Floor of the Hall
<br />County Courthouse, 111 West First Street in the City of Grand
<br />Island, Hall County, Nebraska, which notice was published in the
<br />Grand Island Independent, once a week for five consecutive weeks
<br />commencing on August 31, 2013, and ending on September 28, 2013.
<br />The last publication of notice was at least ten days prior to the
<br />Trustee's sale held on October 18, 2013, and said sale was not
<br />later than thirty days after the last publication of notice;
