2 O13O644G <br />Landlord from any and all claims for such damages, regardless of <br />how caused, the active and actionable negligence of Landlord <br />excepted. <br />15. Notices. All notices provided for or permitted to be <br />given under this Lease shall be deemed to have been duly given <br />only if in writing and when deposited in the United States mail, <br />properly stamped, by certified mail, return receipt requested, <br />and addressed as follows: <br />(a) If to Tenant: Patty Cummings <br />1629 Lariat Lane <br />Grand Island, NE 68803; and <br />(b) If to Landlord: Jamie Cummings and Anne Cummings <br />1206 E. 31 Street <br />Kearney, NE 68847. <br />If mailed in accordance with this Paragraph, notice shall be <br />effective when deposited in the United States mail. <br />16. Time of Essence. Time is of the essence of this Lease <br />and all the conditions and contingencies contained herein. <br />17. Receipt of Copy of Lease. Tenant, by the execution <br />hereof, acknowledges receipt of a signed copy of this Lease. <br />18. Entire Agreement. This Lease constitutes the entire <br />agreement between the parties, and may be modified or amended <br />only by a writing signed by Landlord and Tenant. <br />19. Binding Upon Heirs, Successors & Assigns. This Lease <br />shall be binding upon and inure to the benefit of the parties <br />hereto, their heirs, personal representatives, successors and <br />assigns. <br />20. Notice Recording. This Lease or a notice memorandum of <br />this Lease shall be recorded with the Hall County Register of <br />Deeds with respect to the leased premises. <br />5 <br />
