(C) The various zoning classifications of the land shown on the Official Zoning Map of the Village of Alda, Nebraska, are hereby confirmed. (D) There is unity of interest in the use of said tract of land, lots, tracts, highways, and streets with the use of land in the Village, and community convenience and welfare and the interests of the Village will be enhanced by incorporating the subject land into the corporate limits of the Village of Alda, Nebraska. Section 2. The boundaries of the Village of Alda, Nebraska, are hereby extended to include within the corporate limits of said Village the contiguous and adjacent tract of land located within the boundaries described above. Section 3. The subject tract of land is hereby annexed to the Village of Alda, Hall County, Nebraska, and said land and the persons thereon shall thereafter be subject to all rules, regulations, ordinances, taxes, and all other burdens and benefits of other persons and territory included within the Village. Section 4. The owners of the land so brought within the corporate limits of the Village of Alda, Nebraska, are hereby compelled to continue with the streets, alleys, easements, and public rights -of -way that are presently platted and laid out in and through said real estate in conformity with and continuous with the streets, alleys, easements, and public rights -of -way of the Village. Section 5. A certified copy of this Ordinance shall be recorded in the office of the Register of Deeds of Hall County, Nebraska, and indexed against the tract of land. Section 6. Upon taking effect of this Ordinance, the services of the Village of Alda shall be furnished to the lands and persons thereon as provided by law, in accordance with a plan to be adopted by the Village not later than one year after the effective date of this Ordinance. Section 7. If any provision of this Ordinance is declared unconstitutional, or the application thereof to any person or circumstance is held invalid, the constitutionality of the remainder of this Ordinance and its applicability to other persons and circumstances shall not be affected thereby. Section 8. Any other ordinance or section passed and approved prior to the passage, approval, and publication or posting of this Ordinance and in conflict with its provisions is hereby repealed. Section 9. This Ordinance shall take effect and be in full force from and after its passage, approval, and publication or posting as required by law. PASSED AND APPROVED this 7 day of May, 2013.
