ORDINANCE NO. 272 <br />201304208 <br />AN ORDINANCE TO EXTEND THE BOUNDARIES AND INCLUDE WITHIN THE <br />CORPORATE LIMITS OF, AND TO ANNEX INTO, THE VILLAGE OF ALDA, <br />NEBRASKA, A TRACT OF LAND LOCATED IN PART OF THE NORTHEAST QUARTER <br />OF SECTION 5, TOWNSHIP 10 NORTH, RANGE 10 WEST OF THE 6th P.M., AND IN <br />PART OF THE SOUTHEAST QUARTER OF SECTION 32, TOWNSHIP 11 NORTH, <br />RANGE 10 WEST OF THE 6th P.M., CONSTITUTING UNION PACIFIC RAILROAD <br />RIGHT -OF -WAY, ALONG WITH ALL ADJOINING PUBLIC RIGHT -OF -WAY IN HALL <br />COUNTY, NEBRASKA, AS MORE PARTICULARLY DESCRIBED HEREINAFTER AND <br />AS SHOWN ON EXHIBIT "A" ATTACHED HERETO; TO PROVIDE SERVICE BENEFITS <br />THERETO; TO REPEAL ANY ORDINANCE OR RESOLUTIONS OR PARTS THEREOF IN <br />CONFLICT HEREWITH; AND TO PROVIDE THE EFFECTIVE DATE OF THIS <br />ORDINANCE. <br />WHEREAS, upon referral by the Village of Alda for recommendations, and after public <br />hearing on November 7, 2012, the Hall County Regional Planning Commission recommended <br />the approval of annexing the following tract of land into the Village of Alda: <br />A parcel of land located in the Northeast Quarter of Section 5, Township 10 <br />North, Range 10 West and in the Southeast Quarter of Section 32, Township 11 <br />North, Range 10 West of the Sixth P.M., Hall County, Nebraska, being described <br />as follows: Referring to the Northwest Corner of the Northeast Quarter of Section <br />5; thence easterly on the North Line of said Northeast Quarter, a distance of <br />884.57 feet to the Westerly Right -of -Way Line of the Union Pacific Railroad Spur <br />and the Point of Beginning; thence continuing on said North Line to the <br />Northwesterly Right -of -Way Line of the Union Pacific Railroad; thence <br />southwesterly on said Northwesterly Right -of -Way Line to the West Line of said <br />Northeast Quarter; thence southerly on said West Line to the Southeasterly Right - <br />of -Way Line of the Union Pacific Railroad; thence northeasterly on said <br />Southeasterly Right -of -Way Line to the to the East Line of the Southeast Quarter <br />of Section 32; thence northerly on said East Line to said Northwesterly Right -of- <br />Way Line; thence southwesterly on said Northwesterly Right -of -Way Line to the <br />Easterly Right -of -Way Line of the Union Pacific Railroad Spur; thence <br />northwesterly on said Easterly Right -of -Way Line on a curve to the right to a <br />point of tangency; thence westerly to the Westerly Right -of -Way Line of said <br />Union Pacific Railroad Spur; thence southerly on said Westerly Right -of -Way <br />Line to the Point of Beginning; <br />and <br />WHEREAS, following a public hearing by the Village of Alda upon the recommendation <br />of the Regional Planning Commission this Ordinance has now been read by title on three <br />different days, following which reading it was duly moved and seconded for passage. <br />BE IT ORDAINED BY THE CHAIRPERSON AND BOARD MEMBERS OF THE <br />VILLAGE OF ALDA, NEBRASKA: <br />Section 1. It is hereby found and determined that: <br />(A) The above - described tract of land is urban or suburban in character, and the <br />subject properties are contiguous or adjacent to the corporate limits of the Village <br />of Alda, Nebraska. <br />(B) Upon annexation to the Village, the subject lands will receive the material <br />benefits and advantages currently provided to land within the Village's corporate <br />limits, including but not limited to police, fire, emergency services, street <br />
