Powers granted my attorney -in -fact. I hereby give, grant and bestow upon my attorney -in- <br />fact the following powers: <br />(a) to sell, transfer and convey the homestead and any other real property; to make, <br />execute, acknowledge, endorse and deliver for me all contracts, extensions, <br />closing statements, assignments, escrow agreements, affidavits, deeds and all <br />other documents and instruments of whatever kind necessary to consummate <br />the sale of the Subject Property upon whatever terms my attorney shall deem <br />acceptable; to transfer and convey to any Grantee whomsoever for such sum <br />and on such terms and with such agreements as to him or her shall seem <br />proper; deliver good and sufficient conveyances for the same upon any such <br />consideration and with any such clauses, covenants and agreements to be <br />therein contained as my attorney -in -fact shall think fit and convenient; <br />(b) to purchase, acquire, manage, and control all of my interest in and to the <br />Subject Property; to demise or lease Subject Property to such person or persons <br />and for such rent as he may see fit; to make, execute and acknowledge all <br />documents necessary to purchase, acquire, lease or manage Subject Property; <br />(c) to borrow money on my behalf from any individual or institution; to make, <br />execute, deliver and acknowledge any mortgages, deeds of trust, promissory <br />notes, construction loan agreements, interim financing agreements, long -term <br />financing agreements, or any other forms of encumbrances thereon as my <br />attorney -in -fad: shall deem necessary; <br />(d) to recover, collect and receive all sums of money which shall become due and <br />owing to me in my name by means of any sale, conveyance or lease and to take <br />all lawful ways and means for the recovery thereof, to execute and deliver <br />sufficient acquittances, releases and discharges therefore as well as of any lien or <br />liens securing any obligation arising in connection therewith; <br />(e) to act under changed conditions, the exact nature of which cannot now be <br />foreseen, it being intended to vest in my said attomey, and I do hereby vest in <br />my said attorney, full power to control and manage Subject Property, giving and <br />granting to my attorney -in -fact full power and authority to do and perform all <br />and every act and thing whatsoever requisite and necessary to be done in <br />connection with the Subject Property. <br />2.
