Un�/'otmity; Common Plan. The provisions hereof shall apply w�iformly W the endre <br /> � Project to establish and carry out a common plan for ttie use, development, and improvement of the Project <br /> Site. <br /> Section 9. Remedies; E►�j'orceability. In the event of a violation or attempted violation of any of the <br /> � provisions hereof, any one or more of the following may institute and prosecute any proceeding at Iaw or in <br /> equity to abate� prevent or enjoin any such violadon or attempted violarion, or to recover monetary damages <br /> caused by such violation or attempted violadon: the Authoriry or any governmental eatiry succeeding to the <br /> ' Ruttzarit-�r's �u�ciiva� ar aay� i�3i:�idusl�:�ho mseir the In��mp IimiLt�o�+ 2�+�licahle under Section 42 of the <br /> Code (whether prospective,present or former occupant). The provisions hereof are imposed upon and made <br /> applicable to the Project and shall run with the land and shall be enforceable against the Owner and each <br /> i purchasar, grantee� owner or lessee of the Project or any portion thereof or interest therein, at any time and <br /> from dme to time,and the respective heirs,legal repnsentatives,successors and assigns of the Owner and each <br /> such purchaser, grantee. owaer or lessee. No delay in enforcing the provisions hereof as to any bnach or <br /> violatioa shall impair, damage or waive the right of any party entitled to enforce the same or obtain relief <br /> against or r�xover for the continuarion or repetitioa of such breach or violarion of any similaz breach or <br /> violatioa thereof at any later rime or tunes. Yn addition, if any violation of this Agrament has not been <br /> corrected on a timely basis� the Authoriry may impose quarterly reporting responsibilities pertaining w such <br /> matters as the Authority de�ms reasonable upon the Owner. Failure by an Owner w comply with aay such. <br /> reporting responsibilities shaU constitute a violation of tl�iis Agreement. <br /> Section 10. Amendment; Tirm�nation. The provisions hereof shall not be amended� revised or <br /> terminated(except as provided in Secdon S of this Agreement) prlor to the stated term hereof except by an <br /> instrument in writing duly executsd by the Authority and the Owuer (or its successors in title) and duly <br /> recordal.
